Freedom of Speech is not so absolute!

There are consequences to speech – think: defamation, libel and slander – and so there is the need for some curtailment. One cannot just say anything they want about a person or product and not expect some consequences. There is the classic “Fire in a Crowded Theater” scenario.

The intent is the key.

If one says “fire”, knowing full well that there is no fire, he-she may only want to rile people up and make them stampede; then there may be legal consequences. One can be charged with inciting a riot, willful disregard to safety, depraved indifference or manslaughter.

This is serious … in the physical world.

How about the virtual world?

Same rules … and consequences apply. Now we have medical doctors and clinicians on guard about negative comments-reviews-ratings from patients and customers. See the VIDEO & news story of this threat here:

Title: Doctors, hospitals sue patients who post negative comments, reviews on social media

CLEVELAND – Retired Air Force Colonel David Antoon agreed to pay $100 to settle what were felony charges for emailing his former Cleveland Clinic surgeon articles the doctor found threatening and posting a list on Yelp of all the surgeries the urologist had scheduled at the same time as the one that left Antoon incontinent and impotent a decade ago.

He faced up to a year in prison.

Antoon’s 10-year crusade against the Cleveland Clinic and his urologist is unusual for its length and intensity, as is the extent to which Cleveland Clinic urologist Jihad Kaouk was able to convince police and prosecutors to advocate on his behalf.

Antoon’s plea deal last week came as others in the medical community aggressively combat negative social media posts, casting a pall over one of the few ways prospective patients can get unvarnished opinions of doctors.

Among recent cases:

  • Cleveland physician Bahman Guyuron sued a former patient for defamation for posting negative reviews on Yelp and other sites about her nose job. Guyuron’s attorney Steve Friedman says that although the First Amendment protects patients’ rights to post their opinions, “our position is she did far beyond that (and) deliberately made false factual statements.”  A settlement mediation is slated for early August, and a trial is set for late August if no agreement is reached.
  • Jazz singer Sherry Petta used her own website and doctor-rating sites to criticize a Scottsdale, Arizona, medical practice over her nasal tip surgery, laser treatment and other procedures. Her doctors, Albert Carlotti and Michelle Cabret-Carlotti, successfully sued for defamation. They won a $12 million jury award that was vacated on appeal. Petta claimed the court judgment forced her to sell a house and file bankruptcy. The parties would not discuss the case and jointly asked for it to be dismissed in 2016 but declined to explain why.
  • A Michigan hospital sued an elderly patient’s two daughters and a granddaughter over a Facebook post and for picketing in front of the hospital they said mistreated the late Eleanor Pound. The operator of Kalkaska Memorial Health Center sued Aliza Morse, Carol Pound and Diane Pound for defamation, tortious interference and invasion of privacy.

Petta’s attorney, Ryan Lorenz, says consumers need to know there can be consequences if they post factually incorrect information. Lorenz, who has represented both consumers and businesses on cases involving online comments, says consumers are allowed to offer opinions that do not address factual points.

“Make sure what you are saying is true – it has to be truthful,” he says.

“It would be great if the regulators of hospitals and doctors were more diligent about responding to harm to patients, but they’re not, so people have turned to other people,” says Lisa McGiffert, former head of Consumer Reports’ Safe Patient Project. “This is what happens when your system of oversight is failing patients.”

As doctors and hospitals throw their considerable resources behind legal fights, some patients face huge legal bills for posting critiques and other consumers face their own challenges trying to get a straight story.

Experts say doctors take on extra risk when they resort to suing a patient.

Doctors typically can’t successfully sue third-party websites such as Yelp that allow consumer comments, but they can sue patients over reviews.

Even so, “you can win (a case) and still not win,” says Eric Goldman, a professor at Santa Clara University’s law school.

Goldman, who has tracked about two dozen cases of doctors suing patients over online reviews, says physicians rarely win the cases and sometimes must pay the patients’ legal fees.

Physician-patient confidentiality rules complicate options for doctors, Goldman says, but they can respond to factually incorrect reviews if the patient agrees to waive confidentiality and publicly discuss the case.

The comments challenged legally are typically those that were left online. Many medical review sites will remove posts they deem offensive or threatening to doctors, as many of Antoon’s or other Kaouk patients’ were. Yelp removes reviews only if they violate the consumer website’s terms of service.

Patients should first bring up complaints directly to the doctor or other medical provider, says Edward Hopkins, an attorney who represented Carlotti, Cabret-Carlotti and their medical practice for part of the case. Other options could include reporting a doctor to state oversight agencies, consulting with an attorney or filing complaints with a state attorneys’ general office.

Advocacy or obsession?

By the time he was arrested last December, Antoon had tried most every option with very little success.

Along the way, Antoon became a patient advocate – volunteering with Consumer Reports’ Safe Patient Project and HealthWatch USA – and advising others who say they were harmed by Kaouk and the Cleveland Clinic.

Cleveland Clinic, one of the top-rated hospitals in the country, has an aggressive legal department. Kaouk and the clinic prevailed in malpractice and fraud cases filed by Antoon and other patients who claimed they were harmed.

Matthew Donnelly, Cleveland Clinic’s deputy chief legal officer, attended Antoon’s criminal hearing in November.

To Kaouk, a decade of negative reviews on social media led to what he considered an escalation when Antoon sent him several emails, including one with a link to an article about a Chinese crackdown on research fraud that could include the death penalty if people were injured or killed.

The day before Antoon posted on Yelp in November, Kaouk was granted a civil stalking protective order against Antoon, which barred him from contacting the doctor.

“What would be next – showing up at my door?” Kaouk said in court. “That’s what we feared.”

In his posts and emails, Antoon documented alleged issues, including Kaouk and the urology department’s lack of credentials to use the robotic device in his surgery. He sent records to the Centers for Medicare and Medicaid Services (CMS), claiming they showed Kaouk was not present in the operating room during his surgery despite his insistence that only Kaouk could perform the surgery.

The Ohio Medical Board closed its investigation into Kaouk after five years without reprimanding him in any way. Antoon’s complaints to CMS temporarily put the hospital’s $1 billion annual Medicare reimbursement at risk.

Antoon’s claims were rejected, and Kaouk was not held liable for the surgery that left Antoon impotent and incontinent.

Along with more than $40,000 defending himself against the criminal charges, Antoon spent almost two days in jail. He had to post $50,000 bond in Shaker Heights and again in Cleveland’s Cuyahoga County after the case was transferred there.

It’s common “for someone in a position of wealth, power and money to go after someone like David to silence critics,” says Antoon’s attorney, Don Malarcik. “That happens often and it happened here.”

Hospitals, including the Cleveland Clinic, combat negative comments with their own rating systems, which let them “control their message,” McGiffert says.

Some comments posted by Antoon and Dan Galliano, another patient who claimed he was injured, disappeared from the websites RateMDs and Vitals, as shown in screenshots Antoon took right after they were posted.

Cleveland Clinic spokeswoman Eileen Sheil says it posts all the government-required satisfaction survey responses patients fill out about doctors on its ratings site, once at least 30 are received. Comments aren’t edited.

Sheil says Cleveland Clinic will request comments to be removed from other sites when they violate the sites’ terms of service.

RateMDs did not respond to requests for comment. Vitals spokeswoman Rosie Mattio says the site has a care team that will investigate reviews it is contacted about.

“While we will not pull down a necessarily negative review, we will remove the review if we find that it violates our terms and includes material that is threatening, racist or vulgar,” Mattio says.

Navigating Yelp

On Yelp, business owners can flag a review to be removed for violation of Yelp’s terms of services. Yelp reviews flagged comments and removes those that include hate speech or a conflict of interest or that are not based on a commenter’s firsthand experience.

The website doesn’t intervene over factual disputes, Yelp spokeswoman Hannah Cheesman says. Instead, it classifies consumer reviews as “recommended” or “not currently recommended” based on an automated software review.

If Yelp’s software detects multiple reviews from the same IP address or biased reviews from a competitor or disgruntled employee, it puts the comment in the not-recommended category. Consumers can still view such reviews by clicking on another page, but those comments are not factors in Yelp’s five-star rating system.

McGiffert has long advocated for a federal database where people could report medical errors and infections. Unless that happens, online review sites – including hospitals’ own and ones that will remove some reviews doctors object to – are among the only places patients can find physician reviews.

Doctors such as Kaouk suggest they are the ones who are disadvantaged.

“It is something that if anybody would look just by Googling my name online, you would see what he has written about me,”  Kaouk says of Antoon.

There is a professional industry whose purpose is to conduct disinformation campaigns, plant seeds of doubt and even declare outright lies as dissenting views. These are Bad Actors.

The Go Lean book serves as a roadmap for the introduction and implementation of the technocratic Caribbean Union Trade Federation (CU), for the elevation of Caribbean society – for all member-states. Internet & Communications Technology is expected to be a major factor in this roadmap – ‘the great equalizer’. This CU/Go Lean roadmap has these 3 prime directives:

  • Optimization of the economic engines in order to grow the regional economy to $800 Billion and create 2.2 million new jobs. ICT strategies, tactics and implementations are paramount in delivering economic empowerments.
  • Establishment of a security apparatus to ensure public safety, ensure justice institutions and protect the resultant economic engines. ICT strategies, tactics and implementations are important in optimizing security provisions, imagine intelligence gathering and analyzing systems.
  • Improve Caribbean governance to support these engines, including a separation-of-powers between the member-states and CU federal agencies. E-Government will be the hallmark of the CU technocracy, so ICT strategies, tactics and implementations are paramount in delivering better governance.

The requisite investments to deploy the latest-greatest strategies, tactics and implementations in the art and science of ICT are too big for any one Caribbean member-state alone. So the Go Lean book stresses that reforming and transforming the Caribbean societal engines must be a regional pursuit. This was an early motivation for the roadmap, as pronounced in the opening Declaration of Interdependence (Pages 12 – 14):

xi. Whereas all men are entitled to the benefits of good governance in a free society, “new guards” must be enacted to dissuade the emergence of incompetence, corruption, nepotism and cronyism at the peril of the people’s best interest. The Federation must guarantee the executions of a social contract between government and the governed.

xvi. Whereas security of our homeland is inextricably linked to prosperity of the homeland, the economic and security interest of the region needs to be aligned under the same governance. Since economic crimes … can imperil the functioning of the wheels of commerce for all the citizenry, the accedence of this Federation must equip the security apparatus with the tools and techniques for predictive and proactive interdictions.

xxiv. Whereas a free market economy can be induced and spurred for continuous progress, the Federation must install the controls to better manage aspects of the economy: jobs, inflation, savings rate, investments and other economic principles. Thereby attracting direct foreign investment because of the stability and vibrancy of our economy.

xxvii. Whereas the region has endured a spectator status during the Industrial Revolution, we cannot stand on the sidelines of this new economy, the Information Revolution. Rather, the Federation must embrace all the tenets of Internet Communications Technology (ICT) to serve as an equalizing element in competition with the rest of the world. The Federation must bridge the digital divide and promote the community ethos that research-development is valuable and must be promoted and incentivized for adoption.

The Go Lean book provides 370-pages of turn-by-turn instructions on “how” to adopt new community ethos, plus the strategies, tactics, implementations and advocacies to execute so as to reboot, reform and transform the societal engines of Caribbean society. One advocacy presented in the book – 10 Ways to Improve Communications (Page 186) – focuses on the “art and science” of media (communications). The following tidbits are retrieved from that page:

# 3 – Media Industrial Complex
The CU will oversee the radio spectrum used for radio, television and satellite communications. The radio spectrum must be regulated on a regional level, because the islands are so close to each other and foreign states, that there must be coordination of the common resource pool – the spectrum is limited. This FCC-style (USA) oversight will also extend to internet broadband (wireless & wire-line) governance. With the CU’s financial reforms, the emergence of card-based and e-payment systems will allow for the full exploitation of the media business models. Also, the CU, through licensing, can mandate a certain amount of programming of the educational, inspirational and public service variety.

The Bottom Line on Old Media versus New Media
The internet and mobile communications has changed the modern world; many industries that once flourished (music retailers, travel agencies, book sales, line telephone companies), now flounder. Media distribution via the internet or mobile devices are referred to as “new media”, while old distribution channels like newspapers, magazines, TV and radio are referred to as “old media”. The mainstream (“old”) media is pivotal for “freedom of the press” as they are effective at standing up to big institutions like governments and corporations. The art of “good” journalism requires the deeper pockets that mainstream media bring to the market, but old media is dying financially. New media, on the other hand, is an aggregation of mainstream media. With the ubiquity of new media devices, people have freer, easier access and more options to news and information. On the plus side, there is now a greater diversity of ideas and viewpoints, on the minus side, with too many options, people tend to isolate their news consumption to only the views they want to hear. As new media matures, it is expected that it will take over the social responsibilities of old media, adopt the best practices of journalism, like fact checking (with the ease of information retrieval online), and finally return the industry to financial viability.

In summary, there are 2 Take-aways from this commentary:

(1) While there is  “Freedom of Speech”, there is no freedom from the consequences of speech.

(2) While there is “Freedom of the Press”, if the press is profit-oriented then popularity may be a greater priority than truth.

These dictate that there must be a stronger need for accuracy, integrity and professionalism in the age of New Media – disinformation can cause a lot of harm, fast.

There are lessons for the Caribbean to learn from other lands – America, China, and others. China is heavy-handed with their policing of media outlets, including online. This is definitely a bridge too far … for us in the Caribbean! India, though has a great model of a Chief Grievance Officer.

The Caribbean, sitting on the border with the United States of America allows us to look-listen-learn from the American experience. Our conclusion: We do not want to be America … we want to be better.

Yes, we can … get this right, and make our homeland a better place to live, work and play. 🙂

Ready for Football 2018? – ENCORE

  • Friday Night Lights – A reference to High School Football, starts in earnest today.
  • College Football – This is Week 1 of 14 of the 2018 season, starting today.

  • National Football League (NFL) – The 16 week season starts on Sunday September 9, 2018; it will then be followed with a 5 week playoff, capped by SuperBowl LIII in the Mercedes-Benz Stadium in Atlanta on February 3, 2019.

This commentary has frequently focused on this American past time. We have highlighted the “art and science” of the sport, the business and the pride.

But there is one caution that we feel the need to constantly remind the Caribbean eco-system about when it comes to American football; this is the very real threat with Concussions.

Every year, month and week that goes by, we learn more and more about the dangers of Concussions and the dreaded disease Chronic Traumatic Encephalopathy (CTE). We are learning now that the onslaught of this affliction is so much worse than originally thought:

A new study out of Boston diagnosed a startlingly high percentage of deceased NFL players with chronic traumatic encephalopathy (CTE), and the numbers don’t get much better when you move on down to college players.

Researchers from VA Boston Healthcare System (VABHS) and Boston University School of Medicine looked at the brains of 202 deceased American football players. All told, the researchers found 87 percent of the players to have CTE, a degenerative brain disease commonly found in athletes and military veterans with a history of head trauma.

Among NFL players, that percentage shot all the way up to 99 percent. In fact, only one of the 111 deceased NFL players analyzed did not have CTE.

“It is no longer debatable whether or not there is a problem in football; there is a problem,” Ann McKee, director of BU’s CTE Center, said in a statement. ”[I]t is time to come together to find solutions,”

But it’s not just NFL players who are at risk. Among college football players involved in the study, 91 percent were diagnosed with CTE. Even among those subjects that only played high school football, 21 percent were found to have CTE.

Go Lean Commentary – ‘Concussions’ – The Movie; The Cause

“Are you ready for some football?” – Promotional song by Hank Williams, Jr. for Monday Night Football on ABC & ESPN networks for 22 years (1989 – 2011).

This iconic song (see Appendix) and catch-phrase is reflective of exactly how popular the National Football League (NFL) is in the US:

“They own an entire day of the week”.

- The Movie; The Cause - Photo 2So says the new movie ‘Concussions’, starring Will Smith, referring to the media domination of NFL Football on Sundays during the Autumn season. The movie’s script is along a line that resonates well in Hollywood’s Academy Award balloting: “David versus Goliath”; “a small man speaking truth to power”.

In the case of the NFL, it is not just about power, it is about money, prestige and protecting the status quo; the NFL is responsible for the livelihood of so many people. The book Go Lean … Caribbean recognized the importance of the NFL in the American lexicon of “live, work and play”; it featured a case study (Page 32) of the NFL and it’s collective bargaining successes (and failures) in 2011. An excerpt from the book is quoted as follows:

Football is big business in the US, $9 billion in revenue, and more than a business; emotions – civic pride, rivalries, and fanaticism – run high on both sides.

While football plays a big role in American life, so do movies. Their role is more unique; they are able to change society. In a previous blog / commentary regarding Caribbean Diaspora member and Hollywood great, Sidney Poitier, it was declared that …

“Movies are an amazing business model. People give money to spend a couple of hours watching someone else’s creation and then leave the theater with nothing to show for the investment; except perhaps a different perspective”.

Yes, movies help us to glean a better view of ourselves … and our failings; and many times, show us a way-forward.

These descriptors actually describe the latest production from Hollywood icon Will Smith (the former Fresh Prince of Bel-Air). This movie, the film “Concussion”, in the following news article, relates the real life drama of one man, Dr. Bennet Omalu, a Nigerian-born medical doctor – a pathologist – who prepared autopsies of former players that suffered from football-related concussions. He did not buckle under the acute pressure to maintain the status quo, and now, he is celebrated for forging change in his adopted homeland. This one man made a difference. (The NFL is now credited for a Concussion awareness and prevention protocol so advanced that other levels of the sport – college, high schools and Youth – are being urged to emulate).

Title: ‘Concussion’: 5 Take-a-ways From Will Smith’s New Film

Will Smith, 46, is definitely going to get a ton of Oscar buzz portraying Dr. Bennet Omalu in the new film “Concussion.” NFL columnist Peter King of Sports Illustrated got an exclusive first peek at the trailer and it has been widely shared on social media since. And it’s very chilling.

Here are five take-aways and background you need to know before checking out the clip:

1 – It’s Based on a True Story

Omalu is the forensic pathologist and neuropathologist who discovered chronic traumatic encephalopathy in football players who got hit in the head over and over again, according to the Washington Post.

In the clip, he says repetitive “head trauma chokes the brain.”

Omalu was one of the founding members of the Brain Injury Research Institute in 2002. He conducted the autopsy of Pittsburgh Steelers center Mike Webster, played by David Morse in the film, which led to this discovery.

2 – Smith’s Version of Omalu’s Accent Is Spot On

Omalu is from Nigeria and Smith has been known to transform completely for a role. He was nominated for an Oscar for 2011’s “Ali,” playing the legendary Muhammad Ali.

3 – Smith Is a Reluctant Hero

“If you don’t speak for them, who will,” Gugu Mbatha-Raw, who plays Prema Mutiso in the film, tells Smith’s character.

He admits he idolized America growing up and “was the wrong person to have discovered this.”

4 – Alec Baldwin and Luke Wilson

“Concussion” brought in some heavyweights for this movie. Baldwin plays Dr. Julian Bailes, who advises Omalu, and Wilson, who will reportedly play NFL Commissioner Roger Goodell, according to IMDB. There’s no official word on this. He’s seen at a podium in the trailer, but doesn’t speak.

5 – “Tell the Truth”

Smith captures Omalu’s passion to have the truth told about this injury and disease.

“I was afraid of letting Mike [Webster] down. I was afraid. I don’t know. I was afraid I was going to fail,” Omalu told PBS a couple years back.

Will Smith stars in the incredible true David vs. Goliath story of Dr. Bennet Omalu, the brilliant forensic neuropathologist who made the first discovery of CTE, a football-related brain trauma, in a pro player.

The subject of concussions is serious – life and death. Just a few weeks ago (August 8), an NFL Hall-of-Fame inductee was honored for his play on the field during his 20-year professional career, but his family, his daughter in particular, is the one that made his acceptance / induction speech. He had died, in 2012; he committed suicide after apparently suffering from a brain disorder – chronic traumatic encephalopathy (CTE), a type of chronic brain damage that has also been found in other deceased former NFL players[4] – sustained from his years of brutal head contacts in organized football in high school, college and in his NFL career. This player was Junior Seau.

Why would there be a need for “David versus Goliath”; “a small man speaking truth to power”? Is not the actuality of an acclaimed football player committing suicide in this manner – he shot himself in the chest so as to preserve his brain for research – telling enough to drive home the message for reform?

No. Hardly. As previously discussed, there is too much money at stake.

These stakes bring out the Crony-capitalism in American society.

The book Go Lean…Caribbean (and subsequent blog/commentaries) relates many examples of cronyism in the American eco-system. There is a lot of money at stake. Those who want to preserve the status quo or not invest in the required mitigations to remediate concussions will fight back against any Advocate promoting the Greater Good. The profit motive is powerful. There are doubters and those who want to spurn doubt. “Concussions in Football” is not the first issue these “actors” have promoted doubt on. The efforts to downplay concussion alarmists are from a familiar playbook, used previously by Climate Change deniers, Big Tobacco, Toxic Waste, Acid Rain, and other dangerous chemicals.

This Go Lean book serves as a roadmap for the introduction and implementation of the technocratic Caribbean Union Trade Federation (CU). Sports are integral to the Go Lean/CU roadmap. While sports can be good and promote positives in society, even economically, the safety issues must be addressed upfront. This is a matter of community security. Thusly, the prime directives of the CU are described as:

  • Optimize the economic engines of the Caribbean to elevate the regional economy to grow to $800 Billion and create 2.2 million new jobs, including sports-related industries with a projection of 21,000 direct jobs at Fairgrounds and sports enterprises.
  • Establish a security apparatus to protect the people and economic engines.
  • Improvement of Caribbean governance to support these economic and security engines.

The CU/Go Lean sports mission is to harness the individual abilities of athletes to not just elevate their performance, but also to harness the economic impact for their communities. So modern sports endeavors cannot be analyzed without considering the impact on “dollars and cents” for stakeholders. This is a fact and should never be ignored. There is therefore the need to carefully assess and be on guard for crony-capitalistic influences entering the decision-making of sports stakeholders. The Go Lean book posits that with the emergence of new economic engines, “bad actors” will also emerge thereafter to exploit the opportunities, with good, bad and evil intent”. These points were pronounced early in the opening Declaration of Interdependence (Page 12 &14):

x. Whereas we are surrounded and allied to nations of larger proportions in land mass, populations, and treasuries, elements in their societies may have ill-intent in their pursuits, at the expense of the safety and security of our citizens. We must therefore appoint “new guards” to ensure our public safety and threats against our society, both domestic and foreign. The Federation must employ the latest advances and best practices of criminology and penology to assuage continuous threats against public safety.

xi. Whereas all men are entitled to the benefits of good governance in a free society, “new guards” must be enacted to dissuade the emergence of incompetence, corruption, nepotism and cronyism at the peril of the people’s best interest. The Federation must guarantee the executions of a social contract between government and the governed.

xvi. Whereas security of our homeland is inextricably linked to prosperity of the homeland, the economic and security interests of the region needs to be aligned under the same governance. Since economic crimes … can imperil the functioning of the wheels of commerce for all the citizenry, the accedence of this Federation must equip the security apparatus with the tools and techniques for predictive and proactive interdictions.

xxxi. Whereas sports have been a source of great pride for the Caribbean region, the economic returns from these ventures have not been evenly distributed as in other societies. The Federation must therefore facilitate the eco-systems and vertical industries of sports as a business, recreation, national pastime and even sports tourism …

The Go Lean book envisions the CU – a confederation of the 30 member-states of the Caribbean chartered to do the heavy-lifting of empowering and elevating the Caribbean economy – as the landlord of many sports facilities (within the Self-Governing Entities design), and the regulator for inter-state sport federations. The book details the economic principles and community ethos to adopt, plus the executions of strategies, tactics, implementations and advocacies to optimize sports enterprises in the Caribbean:

The Go Lean book and accompanying blogs declare that the Caribbean needs to learn lessons from other communities, especially when big money is involved in pursuits like sports. These activities should be beneficial to health, not detrimental. So the admonition is to be “on guard” against the “cronies”; they will always try to sacrifice public policy – the Greater Good – for private gain: profit.

Let’s do better. Yes, the Caribbean can be better than the American experiences.

The design of Self-Governing Entities allow for greater protections from Crony-Capitalistic abuses. While this roadmap is committed to availing the economic opportunities of sports and accompanying infrastructure, as demonstrated in the foregoing movie trailer, sport teams and owners can be plutocratic “animals” in their greed. We must learn to mitigate plutocratic abuses. While an optimized eco-system is good, there is always the need for an Advocate, one person to step up, blow the whistle and transform society. The Go Lean roadmap encourages these role models.

Message to Federal Workforce for Labor Day: “No, on that raise” – ENCORE

In the US, today kicks-off Labor Day holiday weekend. The head of the Federal Government, President Donald Trump, sends out a message to the millions of federal employees:

Remember that raise you were approved for?

Nevermind!

Washington (CNN) – President Donald Trump told lawmakers on Thursday he wants to scrap a pay raise for civilian federal workers, saying the nation’s budget couldn’t support it.

In a letter to House and Senate leaders, Trump described the pay increase as “inappropriate.”

    “We must maintain efforts to put our Nation on a fiscally sustainable course, and Federal agency budgets cannot sustain such increases,” the President wrote. An across-the-board 2.1% pay increase for federal workers was slated to take effect in January. In addition, a yearly adjustment of paychecks based on the region of the country where a worker is posted — the “locality pay increase” — was due to take effect.

Trump said both increases should no longer happen.

Labor Day is a day set aside to honor workers. It is not just an American tradition. No, many countries have an equivalent of Labor Day. Many of the historicity of these movements were tied to labor unions.

The field of Economics is unique! We all practice it every day, no matter the level of skill or competence. There is even the subject area in basic education branded Home Economics, teaching the students the fundamentals of maintaining, supporting and optimizing a home environment. Most assuredly, economics is an art and a science, albeit a social science.

In a previous blog/commentary, Scotman’s Adam Smith was identified as the father of modern macro-economics. Though he lived from 1723 to 1790, his writings defined advanced economic concepts even in this 21st Century. His landmark book An Inquiry into the Nature and Causes of the Wealth of Nations qualified the divisions of income into these following categories: profit, wage, and rent.[4] We have previously explored profit-seeking (a positive ethos that needs to be fostered in the Caribbean region) and rent-seeking (a negative effort that proliferates in the Caribbean but needs to be mitigated), so now the focus of this commentary is on the activity of wage-seeking, and the concepts of governance and public choice theory to allow for maximum employment.

This is hard! Change has come to the world of wage-seekers – the middle classes are under attack; the labor-pool of most industrialized nations have endured decline, not in the numbers, but rather in prosperity. While wage-earners have not kept pace with inflation, top-earners (bonuses, commissions and business profits) have soared; (see Photo).

In fact, this was an initial motivation for the book Go Lean…Caribbean, stemming from the fall-out of the 2008 Great Recession, this publication was presented as a roadmap for the introduction and implementation of the Caribbean Union Trade Federation (CU) to elevate the economic, security and governing engines of the Caribbean region to create 2.2 million new jobs, despite global challenges.

Needless to say, the global challenge is far more complex than Home Economics. The Go Lean book describes the effort as heavy-lifting; then proceeds to detail the turn-by-turn directions of a roadmap to remediate and mitigate wage-seeking.

The roadmap channels the Economic Principles and best-practices of technocrats like Adam Smith and 11 other named economists, many of them Nobel Laureates. A review of the work of these great men and woman constitute “Lessons in Economic Principles”. Why would these lessons matter in the oversight of Caribbean administration? Cause-and-effect!

Profit 4The root of the current challenge for wage-seekers is income equality; and this is bigger than just the Caribbean. It is tied to the global adoption of globalization and technology/ automation – a product of global Market Forces as opposed to previous Collective Bargaining factors. This relates back to the fundamental Economic Principle of “supply-and-demand”; but now the “supply” is global. This photo/”process flow” here depicts the ingredients of Market Forces. When there is the need for labor, the principle of comparative analysis is employed, and most times the conclusion is to “off-shore” the labor efforts, and then import the finished products. This is reversed of the colonialism that was advocated by Adam Smith; instead of the developed country providing factory labor for Third World consumption, the developed nation (i.e. United States) is now in the consumer-only role, with less and less production activities, for products fabricated in the Third World. This reality is not sustainable for providing prosperity to the middle classes, to the wage-seekers.

As a community, we may not like the laws of Economics, but we cannot ignore them. The Go Lean book explains the roles and significance of Economic Principles … with this excerpt (Page 21):

While money is not the most important factor in society, the lack of money and the struggle to acquire money creates challenges that cannot be ignored. The primary reason why the Caribbean has suffered so much human flight in the recent decades is the performance of the Caribbean economy. Though this book is not a study in economics, it recommends, applies and embraces these 6 core Economic Principles as sound and relevant to this roadmap:

  1. People Choose: We always want more than we can get and productive resources (human, natural, capital) are always limited. Therefore, because of this major economic problem of scarcity, we usually choose the alternative that provides the most benefits with the least cost.
  2. All Choices Involve Costs: The opportunity cost is the next best alternative you give up when you make a choice. When we choose one thing, we refuse something else at the same time.
  3. People Respond to Incentives in Predictable   Ways: Incentives are actions, awards, or rewards that determine the choices people make. Incentives can be positive or negative. When incentives change, people change their behaviors in predictable ways.
  4. Economic Systems Influence Individual Choices and Incentives: People cooperate and govern their actions through both written and unwritten rules that determine methods of allocating scarce resources. These rules determine what is produced, how it is produced, and for whom it is produced. As the rules change, so do individual choices, incentives, and behavior.
  5. Voluntary Trade Creates Wealth: People specialize in the production of certain goods and services because they expect to gain from it. People trade what they produce with other people when they think they can gain something from the exchange. Some benefits of voluntary trade include higher standards of living and broader choices of goods and services.
  6. The Consequences of Choices Lie in the Future: Economists believe that the cost and benefits of decision making appear in the future, since it is only the future that we can influence. Sometimes our choices can lead to unintended consequences.

The Go Lean book describes the end result of the application of best-practices in this field of economics over the course of a 5-year roadmap: the CU … as a hallmark of technocracy. But the purpose is not the edification of the region’s economists, rather to make the Caribbean homeland “better places to live, work and play” for its citizens. This branding therefore puts emphasis on the verb “work”; the nouns “jobs” and “wages” must thusly be a constant focus of the roadmap.

Brain Drain 70 percent ChartThis Go Lean book declares that the Caribbean eco-system for job-creation is in crisis … due to the same global dilemma. The roadmap describes the crisis as losing a war, the battle of globalization and technology. The consequence of the defeat is 2 undesirable conditions: income inequality and societal abandonment, citizens driven away to a life in the Diaspora. This assessment currently applies in all 30 Caribbean member-states, as every community has lost human capital to emigration. Some communities, like Puerto Rico and the US Virgin Islands have suffered with an abandonment rate of more than 50% and others have watched more than 70% of college-educated citizens flee their community for foreign shores. Even education is presented as failed investments as those educated in the region and leave to find work do not even return remittances in proportion to their costs of development. (See Table 4.1 in the Photo)

The Go Lean book therefore posits that there is a need to re-focus, re-boot, and optimize the labor/wage-seeking engines so as to create more jobs with livable wages. Alas, this is not just a Caribbean issue, but a global (i.e. American) one as well. A wage is monetary compensation paid by an employer to an employee in exchange for work done. Payment may be calculated as a fixed amount for each task completed (a task wage or piece rate), or at an hourly or daily rate, or based on an easily measured quantity of work done.

Wages are an example of expenses that are involved in running a business.

Payment by wage contrasts with salaried work, in which the employer pays an arranged amount at steady intervals (such as a week or month) regardless of hours worked, with commission which conditions pay on individual performance, and with compensation based on the performance of the company as a whole. Waged employees may also receive tips or gratuity paid directly by clients and employee benefits which are non-monetary forms of compensation. Since wage labour is the predominant form of work, the term “wage” sometimes refers to all forms (or all monetary forms) of employee compensation.

Determinants of wage rates
Depending on the structure and traditions of different economies around the world, wage rates will be influenced by market forces (supply and demand), legislation, and tradition. Market forces are perhaps more dominant in the United States, while tradition, social structure and seniority, perhaps play a greater role in Japan.[6]

Wage Differences
Even in countries where market forces primarily set wage rates, studies show that there are still differences in remuneration for work based on sex and race. For example, according to the U.S. Bureau of Labor Statistics, in 2007 women of all races made approximately 80% of the median wage of their male counterparts. This is likely due to the supply and demand for women in the market because of family obligations. [7] Similarly, white men made about 84% the wage of Asian men, and black men 64%.[8] These are overall averages and are not adjusted for the type, amount, and quality of work done.

Real Wage
The term real wages refers to wages that have been adjusted for inflation, or, equivalently, wages in terms of the amount of goods and services that can be bought. This term is used in contrast to nominal wages or unadjusted wages. Because it has been adjusted to account for changes in the prices of goods and services, real wages provide a clearer representation of an individual’s wages in terms of what they can afford to buy with those wages – specifically, in terms of the amount of goods and services that can be bought.

WPR: Marches & PicketsCollective Bargaining is a process of negotiation between employers and a group of employees aimed at reaching agreements to regulate working conditions. The interests of the employees are commonly presented by representatives of a trade union to which the employees belong. The collective agreements reached by these negotiations usually set out wage scales, working hours, training, health and safety, overtime, grievance mechanisms, and rights to participate in workplace or company affairs.[1]

The union may negotiate with a single employer (who is typically representing a company’s shareholders) or may negotiate with a group of businesses, depending on the country, to reach an industry wide agreement. A collective agreement functions as a labor contract between an employer and one or more unions.

The industrial revolution brought a swell of labor-organizing in [to many industrialized countries, like] the US. The American Federation of Labor (AFL) was formed in 1886, providing unprecedented bargaining powers for a variety of workers.[11] The Railway Labor Act (1926) required employers to bargain collectively with unions. While globally, International Labour Organization Conventions (ILO) were ratified in parallel to the United Nations efforts (i.e. Declaration of Human Rights, etc.). There were a total of eight ILO fundamental conventions [3] all ascending between 1930 and 1973, i.e. the Freedom of Association and Protection of the Right to Organise Convention (1949).

The Go Lean book presents a roadmap on how to benefit from the above Economic Principles – and how to empower communities anew – in the midst of tumultuous global challenges. This roadmap addresses more than economics, as there are other areas of societal concern. This is expressed in the CU charter; as defined by these 3 prime directives:

  • Optimization of economic engines in order to grow the regional economy to $800 Billion and create 2.2 million new jobs.
  • Establishment of a security apparatus to protect the resultant economic.
  • Improvement of Caribbean governance to support these engines.

Early in the Go Lean book, the responsibility to create jobs was identified as an important function for the CU with these pronouncements in the Declaration of Interdependence (Pages 14):

xix.  Whereas our legacy in recent times is one of societal abandonment, it is imperative that incentives and encouragement be put in place to first dissuade the human flight, and then entice and welcome the return of our Diaspora back to our shores.

xxi.  Whereas the preparation of our labor force can foster opportunities and dictate economic progress for current and future generations, the Federation must ensure that educational and job training opportunities are fully optimized for all residents of all member-states, with no partiality towards any gender or ethnic group. The Federation must recognize and facilitate excellence in many different fields of endeavor, including sciences, languages, arts, music and sports. This responsibility should be executed without incurring the risks of further human flight, as has been the past history.

xxiv. Whereas a free market economy can be induced and spurred for continuous progress, the Federation must install the controls to better manage aspects of the economy: jobs, inflation, savings rate, investments and other economic principles. Thereby attracting direct foreign investment because of the stability and vibrancy of our economy.

xxvi.  Whereas the Caribbean region must have new jobs to empower the engines of the economy and create the income sources for prosperity, and encourage the next generation to forge their dreams right at home, the Federation must therefore foster the development of new industries, like that of ship-building, automobile manufacturing, prefabricated housing, frozen foods, pipelines, call centers, and the prison industrial complex. In addition, the Federation must invigorate the enterprises related to existing industries tourism, fisheries and lotteries – impacting the region with more jobs.

According to an article from the Economic Policy Institute, entitled The Decline of Collective Bargaining and the Erosion of Middle-class Incomes in Michigan by Lawrence Mishel (September 25, 2012), the challenges to middle class income are indisputable, and the previous solution – Collective Bargaining – is no longer as effective as in the past. (The industrial landscape of Michigan had previously been identified as a model for the Caribbean to consider). See a summary of the article here (italics added) and VIDEO in the Appendix:

In Michigan between 1979 and 2007, the last year before the Great Recession, the state’s economy experienced substantial growth and incomes rose for high-income households. But middle-class incomes did not grow. The Michigan experience is slightly worse than but parallels that of the United States as a whole, where middle-class income gains were modest but still far less than the income gains at the top. What the experience of Michiganders and other Americans makes clear is that income inequality is rising, and it has prevented middle-class incomes from growing adequately in either Michigan or the nation.

The key dynamic driving this income disparity has been the divergence between the growth of productivity—the improvement in the output of goods and services produced per hour worked—and the growth of wages and benefits (compensation) for the typical worker. It has been amply documented that productivity and hourly compensation grew in tandem between the late 1940s and the late 1970s, but split apart radically after 1979. Nationwide, productivity grew by 69.1 percent between 1979 and 2011, but the hourly compensation of the median worker (who makes more than half the workforce but less than the other half) grew by just 9.6 percent (Mishel and Gee 2012; Mishel et al. 2012). In other words, since 1979 the typical worker has hardly benefited from improvements in the economy’s ability to raise living standards and, consequently, middle-class families’ living standards have barely budged since then. This phenomenon has occurred across the nation, including in Michigan.

This divergence between pay and productivity and the corresponding failure of middle-class incomes to grow is strongly related to the erosion of collective bargaining. And collective bargaining has eroded more in Michigan than in the rest of the nation, helping to explain Michigan’s more disappointing outcomes.

Research three decades ago by economist Richard Freeman (1980) showed that collective bargaining reduces wage inequality, and all the research since then (see Freeman 2005) has confirmed his finding. Collective bargaining reduces wage inequality for three reasons. The first is that wage setting in collective bargaining focuses on establishing “standard rates” for comparable work across business establishments and for particular occupations within establishments. The outcome is less differentiation of wages among workers and, correspondingly, less discrimination against women and minorities. A second reason is that wage gaps between occupations tend to be lower where there is collective bargaining, and so the wages in occupations that are typically low-paid tend to be higher under collective bargaining. A third reason is that collective bargaining has been most prevalent among middle-class workers, so it reduces the wage gaps between middle-class workers and high earners (who have tended not to benefit from collective bargaining).

Collective bargaining also reduces wage inequality in a less-direct way. Wage and benefit standards set by collective bargaining are often followed in workplaces not covered by collective bargaining, at least where there is extensive coverage by collective bargaining in particular occupations and industries. This spillover effect means that the impact of collective bargaining on the wages and benefits of middle-class workers extends far beyond those workers directly covered by an agreement.

The siren call went out 20 years ago, of the emergence of an “Apartheid” economy, a distinct separation between the classes: labor and management. Former US Secretary of Labor Robert Reich (1993 – 1997 during the Clinton Administration’s First Term) identified vividly, in this 1996 Harvard Business Review paper, that something was wrong with the U.S. economy then; (it is worst now):

That something is an issue normally on the back burner in U.S. public discourse: the distribution of the fruits of economic progress. For many, the rise in AT&T’s stock after it announced plans [on January 3, 1996] to lay off 40,000 employees crystallized the picture of an economy gone haywire, with shareholders gaining and employees losing as a result of innovation and advances in productivity.

Has the distribution of the benefits of economic growth in the United States in fact gone awry? Is the nation heading toward an apartheid economy—one in which the wealthy and powerful prosper while the less well-off struggle? What are the facts? What do they mean? Are there real problems—and can they be solved?

Deploying solutions for the problem of income equality in the Caribbean is the quest of the Go Lean/CU roadmap. The book identified Agents of Change (Page 57) that is confronting the region, (America as well); they include: Globalization and Technology. A lot of the jobs that paid a “living wage” are now being shipped overseas to countries with lower wage levels, or neutralized by the advancement of technology. Yes, computers are reshaping the global job market, so even Collective Bargaining may fail to counter any eventual obsolescence of wage-earners, their valuation and appreciation; (see Encyclopedic Article # 2). The Go Lean book, and previous blog/commentaries, therefore detailed the campaign to not just consume technology, but to also innovate, produce and distribute the computer-enabled end-products. Therefore industries relating to STEM (Science, Technology, Engineering and Mathematics/Medicine) are critical in the roadmap. Not only do these careers yield good-paying direct jobs, but also factor in the indirect job market, and the job-multiplier rate (3.0 to 4.1) for down-the-line employment (Page 260) opportunities.

The Go Lean… Caribbean book details the creation of 2.2 million new jobs for the Caribbean region, many embracing ICT/STEM skill-sets. This is easier said than done, so how does Go Lean purpose to deliver on this quest? By the adoption of certain community ethos, plus the executions of key strategies, tactics, implementations and advocacies. The following is a sample from the book:

The CU will foster job-creating developments, incentivizing many high-tech start-ups and incubating viable companies. The primary ingredient for CU success will be Caribbean people, so we must foster and incite participation of many young people into fields currently sharing higher job demands, like ICT and STEM, so as to better impact their communities. A second ingredient will be the support of the community – the Go Lean movement recognizes the limitation that not everyone in the community can embrace the opportunity to lead in these endeavors. An apathetic disposition is fine-and-well; we simply must not allow that to be a hindrance to those wanting to progress – there are both direct jobs and indirect jobs connected with the embrace of ICT/STEM disciplines. The community ethos or national spirit, must encourage and spur “achievers” into roles where “they can be all they can be”. Go Lean asserts that one person can make a difference … to a community (Page 122).

The Caribbean is arguably the best address on the planet, but “man cannot live on beauty alone”, there is the need for a livelihood as well. This is the challenge, considering the reality of unemployment in the region; the jobless rate among the youth is even higher.

The crisis of income inequality for the US is a direct result of free trade agreements, like NAFTA, and China’s Preferential Trading Status. Despite this status, we can benefit from the realities of globalization; jobs are being moved to conducive locations with lower labor costs.  We should invite these investors to look for cheaper labor options, here in the Caribbean region (Haiti, Dominican Republic, Jamaica, etc.). This is the same reality as in Europe with different wage levels for the different countries (see Appendix below); the Caribbean also has these wage differences.

The Go Lean roadmap seeks to foster higher-paying job options: Call Centers, Offshore Software Development Centers, R&D Medical campuses, light-manufacturing and assembly plants for “basic needs” products (food, clothing shelter, energy, and transportation) for Caribbean consumption. This is the successful model of Japan, China and the “East Asia Tigers” economies; these are manifestations of effective Economic Principles.

The Go Lean book therefore digs deeper, providing turn-by-turn directions to get to the desired Caribbean results: a better place to live, work and play. 🙂

Caribbean Unity? Religion’s Role: False Friend

There is no way to miss this; the dread of “pedophile priests” is in the news … again:

The Pope apologizes for the abuse afflicted on victims by thousands of pedophile priests, just in Pennsylvania, after a Grand Jury handed down indictments for the accused priests and the administrators in the cover-up.
“The heart-wrenching pain of these victims, which cries out to heaven, was long ignored, kept quiet or silenced”. – Pope Francis

This is such a Big Story – see VIDEO in the Appendix below – there is even a request for the Pope to resign. Stay tuned to new developments on this “hot issue”; more and more revelations and upheavals are expected to emerge.

While this issue originated in the US State of Pennsylvania, there are many implications for the Caribbean. This is the same church that sanctioned and authorized the Slave Trade in the first place; (Pope Innocent VIII back in 1491). All of this history – then and now – forces us to ask these questions:

  • What role has the Church had on Caribbean life?
  • Has the Church been a uniting force … for good in the Caribbean?

These are important questions for the Caribbean. This commentary presents the thesis that the Church – the various religion organizations – have been a False Friend for integration, consolidation and collaboration among the Caribbean member-states.

Wait, what?!

The 30 member-states that constitute the political Caribbean have these colonial legacies and predominant religions:

Dutch-speaking – 3 Netherlands Dutch Reform – Protestantism
English-speaking – 18 England – Great Britain – United Kingdom Anglican – Protestantism
French-speaking – 5 France Catholicism
Spanish-speaking – 3 Cuba, Dominican Republic & Puerto Rico Catholicism
American Territories – 2 Puerto Rico & US Virgin Islands Protestantism

Notice this list, both the English and Dutch Caribbean feature a “nationalistic” Church as the predominant religion.

It has long been established that just because these member-states are “Christian”, does not make them “Brothers”. Many wars have been fought in Christian lands where nationalism overrode religious affinity – members of the same faith have fought against each other. Even more animosity have existed in contrasting religious sects: i.e. Catholics versus Protestants.

This reality directly contradicts the statures, principles and spirit of the teachings of the founder of Christianity, Jesus Christ:

35 By this all will know that you are my disciples—if you have love among yourselves.”+ – John 13:35 NWT

This is the assertion (Page 20) of the movement behind the book Go Lean … Caribbean that the Greater Good should be the community ethos – underlying sentiment that informs the beliefs, customs, or practices – that is promoted in the region; that it can be pursued despite any religiosity. This book defines this Greater Good community ethos as follows:

“It is the greatest good to the greatest number of people which is the measure of right and wrong”. Jeremy Bentham (1748-1832)

This is the “why”; now the “how”.

The Go Lean book serves as a roadmap for the introduction and implementation of the Caribbean Union Trade Federation (CU), an intergovernmental entity to empower all 30 Caribbean member-states – both Catholic and Protestants territories. This would constitute a new regime for the region; one that is apolitical and religiously-neutral. We must not favor one religion over another. Rather, we must insist on a clear “Separation of Church and State”, because we have so many different churches in so many States. As related in the foregoing: the Churches will not be a model of behavior and character development. Our ideals must be Greater.

A “Separation of Church and State” mantra is embedded in the implied Social Contract. The Go Lean book defines (Page 170) the Social Contract as follows:

“Citizens surrender some of their freedoms and submit to the authority of the State in exchange for protection of remaining natural and legal rights”.

Some Caribbean countries rely on Churches to deliver specific social services: education, welfare, disaster recovery, etc. But under the Go Lean roadmap, religious institutions will be recognized, respected and defined as Non-Government Organizations (NGO), nothing more … nothing less. Caribbean integration – all the language groups in all 30 member-states operating as one Single Market – is the priority and this priority would facilitate a more efficient delivery of the Social Contract.

The purpose of this commentary is to lament the inadequacies in the Caribbean region, due to our lack of unity or disunity. This completes this series of commentaries on the absurdity of the premise that “there is some Caribbean unity” – what a joke! This submission is 4 of 4 from the Go Lean movement. The consistent theme from the full series is that the full Caribbean – all 30 member-states – have never been able to convene, collude, consolidate, collaborate and confederate. As a result our community have never thrived; and now only barely survive; we are flirting with Failed-State status.

What a joke our disposition has become. This has been declared in all the commentaries in this series, cataloged as follows:

All of these commentaries relate to “how” the stewards for a new Caribbean can finally foster unity in this region. There had been previous attempts at regional integration, all with the same language/heritage grouping. Now, there is the need to recognize the deterrents to regional unity – religious and national alignment – and finally make progress.

God is Good!

The Church? Not so much! The Church must not be a priority! They have been False Friends to the Caribbean. This commentary is not advocating for a God-less society, just a religiously neutral one.

Today, there is the Caribbean Community or CariCom; it is not enough. It includes all the English-speaking territories, plus Haiti and Suriname. But that is only 20 member-states – in a Full or “Associated Member” status. “We” need universal participation for all neighbors in the neighborhood. This means you:

  • Cuba
  • French Caribbean
  • US Virgin Islands
  • Puerto Rico (Currently Observer status only)
  • Dominican Republic (Currently Observer status only)
  • Dutch Caribbean (Currently Observer status only)

These countries must be welcomed into the full brotherhood of an integrated Caribbean, despite any differences in religious affinity. That separation is very important; there are so many other issues at stake; think: economics, security (justice) and governance. The Go Lean/CU roadmap stresses the strategies, tactics and implementations to impact these societal engines. In fact, these statements are identified as the prime directives for the roadmap:

  • Optimize the economic engines in order to grow the regional economy to $800 Billion & create 2.2 million new jobs.
  • Establish a security apparatus to protect the resultant economic engines, plus ensure public safety and justice institutions.
  • Improve Caribbean governance to support these engines, including a separation-of-powers between the member-states and CU federal agencies, plus even oversight for NGO’s.

These prime directives transcend religions, languages or culture. They are designed to just deliver … on the empowerments that the homeland needs. The approach is to move the Caribbean region to a Single Market. CariCom started this vision, but failed to deliver on it. As related in the first commentary in this series, this new CU regime embraces the spirit of CariCom – the need for integration – but with a stronger foundation, one that includes all the neighbors in the neighborhood.

The book Go Lean…Caribbean – available to download for free – opened with the assessment that the challenges belying the Caribbean are Too Big for anyone one member-state alone – there must be regional solutions. Thusly, the book calls for a regional interdependence. This need was pronounced in the opening Declaration of Interdependence (Pages 11 – 13):

vi. Whereas the finite nature of the landmass of our lands limits the populations and markets of commerce, by extending the bonds of brotherhood to our geographic neighbors allows for extended opportunities and better execution of the kinetics of our economies through trade. This regional focus must foster and promote diverse economic stimuli.

viii. Whereas the population size is too small to foster good negotiations for products and commodities from international vendors, the Federation must allow the unification of the region as one purchasing agent, thereby garnering better terms and discounts.

x. Whereas we are surrounded and allied to nations of larger proportions in land mass, populations, and treasuries, elements in their societies may have ill-intent in their pursuits, at the expense of the safety and security of our citizens. We must therefore appoint “new guards” to ensure our public safety and threats against our society, both domestic and foreign. …

xi. Whereas all men are entitled to the benefits of good governance in a free society, “new guards” must be enacted to dissuade the emergence of incompetence, corruption, nepotism and cronyism at the peril of the people’s best interest. The Federation must guarantee the executions of a social contract between government and the governed.

xvi. Whereas security of our homeland is inextricably linked to prosperity of the homeland, the economic and security interest of the region needs to be aligned under the same governance. Since economic crimes … can imperil the functioning of the wheels of commerce for all the citizenry, the accedence of this Federation must equip the security apparatus with the tools and techniques for predictive and proactive interdictions.

xxiv. Whereas a free market economy can be induced and spurred for continuous progress, the Federation must install the controls to better manage aspects of the economy: jobs, inflation, savings rate, investments and other economic principles. Thereby attracting direct foreign investment because of the stability and vibrancy of our economy.

The Go Lean book provides 370-pages of turn-by-turn instructions on “how” to adopt new community ethos, plus the strategies, tactics, implementations and advocacies to execute so as to transform the Caribbean region into a Single Market with 30 different member-states, all striving for a “better society”. That “better society” is one that pursues the Greater Good. Consider the Chapter excerpts and headlines from this sample on Page 37 entitled:

10 Ways to Impact the Greater Good

1 Lean-in for Caribbean Integration
In addition to economic empowerment, this treaty calls for a collective security pact of the member-states so as to ensure homeland security, law-and-order, and assuage against systemic threats. It is an economic and historical fact that security solutions must accompany economic engines; otherwise any well-intentioned plans will be quickly defeated. As stated in scripture: “the love of money is the root of evil”. The community ethos for the CU therefore is for the greater good, at all costs.
2 Economic & Enforcement Openness
3 Reconciling the Poor/Black Experience
4 Public Relations – Messaging Against “Rats” (Snitches)
5 Focus on Justice
The CU will push a community ethos for justice and the rule of law, not “honor among thieves”. This will be fomented by the CU practice of transparency and accountability (including legislative oversight).  The many CU institutions for justice will be required to publish milestones and accomplishments so as to engender public trust and confidence.

7 Military Deployments – Embedded Journalists
Since there are security threats for the region there is the need for a military apparatus. But to instill public confidence, the CU defense agencies will allow embedded journalists, even though their publications/broadcasts may be deferred.

10 Foundation [and NGO] Alignment
There are many causes and advocacies that align with philanthropic foundations, NGOs and Not-For-Profits. The CU will liaison with these organizations, give them support and cooperation to pursue the greater good goals for the public.

The Caribbean must foster a better homeland that transcends the False Friends of the Church and other hypocrisies. Religion does have an effect on our culture and society, so we must pay more than the usual attention to their developments. Considering the lessons being learned from the pedophile priest crisis, we must also hold religious organizations – and NGO’s – accountable for their actions and violations of justice norms and requirements.

The Caribbean is unique in that it has forged its own brand of religions:

  • Rastafarianism – The black power movements of the early 1900s helped launch a completely different kind of religion. Based on Christianity and the King James Bible, Rastafarian beliefs also include the worship of Ras (meaning Prince) Tafari of Ethiopia.
  • Creole Religions – The two best-known forms of these Creole religions are Voodoo and Santería. These were most often practiced on French and Spanish islands where Roman Catholicism was the religion of the whites. Other creole faiths/practices include Regla de Palo, Abakuá Secret Society, Espiritismo, Obeah, Myal, and Quimbois. These latter ones, Obeah, Myal, and Quimbois are Afro-Caribbean Creolized forms of witchcraft and healing practices. Ashanti and other linguistically united tribes were brought to the Caribbean as slaves almost exclusively by the British – the French and Spanish thought these Africans to be more likely to rebel. This means that these spiritual practices were performed almost exclusively on British islands, though Quimbois was a popular practice on Martinique and Guadeloupe.

These Afro-Caribbean Creolized forms of religious practices also have disruptive affects on regional unity.

In summary, religion have not been and cannot be the unifying force for the Caribbean; it must be something else.

We present the community ethos of the Greater Good. This is the best way to reform and transform the Caribbean’s societal engines to better allow for our pluralistic realities. This is the quest of the Go Lean roadmap.

All Caribbean stakeholders – church-goers and secularist alike – are urged to lean-in to this roadmap for change … and empowerment. We can make our region a better place to live work and play. 🙂

100 Years of Mandela – ENCORE

Wow, time flies!

It is 100 years now that Nelson Mandela had come into this world, and though his life has ended, his impact continues to reverberate … up to today.

Nelson Rolihlahla Mandela (18 July 1918 – 5 December 2013) was a South African anti-apartheid revolutionarypolitical leader, and philanthropist, who served as President of South Africa from 1994 to 1999. He was the country’s first black head of state and the first elected in a fully representative democratic election. His government focused on dismantling the legacy of apartheid by tackling institutionalized racism and fostering racial reconciliation. Ideologically an African nationalist and socialist, he served as President of the African National Congress (ANC) party from 1991 to 1997.

Zimbabwe - Photo 2If presented the choice, which would you rather be granted: riches or power?

Many would conclude riches, because of societal expressions like the “Golden Rule: He who has the Gold… rules”. Yet the truth is riches can be created and destroyed quickly. This was the experience just recently during the 2008 Great Recession, where people in the US – the richest country on the planet – lost $11 Trillion in net worth in short order.

On the other hand, there is power. History shows that with power, the rights to riches can be granted, exploited and passed on, from century to century, generation to generation. Consider for example the African continent (in particular the southern region) and the Royal Charters that granted abundant wealth to a privileged few:

CU Blog - A Lesson in History - Royal Charter - Zimbabwe -vs- South Africa - Photo 1The British monarchy has issued over 980 Royal Charters.[1] (A formal document issued by a monarch as letters patent, granting a right or power to an individual or a body corporate). A specific charter was issued for the South African region.

The British South Africa Company (BSAC) was established following the amalgamation of Cecil Rhodes‘ Central Search Association and the London-based Exploring Company Ltd which had originally competed to exploit the expected mineral wealth of Mashonaland but united because of common economic interests and to secure British government backing. The company received a Royal Charter in 1889 modeled on that of the English East India Company. Its first directors included the Duke of Abercorn, Rhodes himself and the South African financier Alfred Beit. Rhodes hoped BSAC would promote colonisation and economic exploitation across much of south-central Africa, as part of the “Scramble for Africa“. However, his main focus was south of the Zambezi, in Mashonaland and the coastal areas to its east, from which he believed the Portuguese could be removed by payment or force, and in the Transvaal, which he hoped would return to British control.[1] (Source: http://en.wikipedia.org/wiki/British_South_Africa_Company)

This historic information is being considered in conjunction with the book Go Lean…Caribbean; a publication designed to elevate the region’s economic (create 2.2 million new jobs), security and governing engines. Why would this “Lesson in History” matter in assessing today’s Caribbean status and fate?

It is of utmost importance. This discussion reveals how to reconcile the injustices of the past, and still build a better future. We have good models to consider, in this case the countries of Zimbabwe and South Africa.

In a previous blog/commentary, the issue of the origin of colonial entitlements was detailed at full length. A direct quote relates:

The most iconic of all the Papal Bulls [-“letters patent” or charters issued by a Pope, the Head of the Roman Catholic Church -] was the Inter caetera, a Papal Bull by Pope Alexander VI on 4 May 1493, which set a demarcation between the New Lands to Portugal and Spain; this granted to Spain all lands to the “west and south” … of the islands of the Azores … and all new lands to the East of this pole remained assigned to Portugal.

Just before this world-changing decree, there was an earlier Papal Bull that sealed the fate and would prejudice the African Diaspora for 500 years. The African Slave Trade and institution of “Slavery” was legally predicated on a Papal Bull from Pope Innocent VIII (Giovanni Battista Cybo) in 1491; just months before Christopher Columbus’s historic first voyage

From the origins of slavery, [colonialism] traversed the historic curves of social revolution and evolution. In the 1500, the Protestant movement took hold. As other European powers deviated from Catholicism, Papal Bulls carried no significance to them and compliance was ignored. England and Holland established their own Protestant Churches with their own monarch as head of Church and State; Papal decrees were replaced with Royal Decrees and Charters. The intent and end-result was still the same: territories and lands awarded (colonized) with the stroke of a pen by one European power after another. The Royal Decrees and Charters were then reinforced with a strong military presence and many battles…

[The resultant] “oligarchy” … power effectively rested with a small number of people. These people could be distinguished by royalty, wealth, family ties, education, corporate, religious or military affiliation.

In this discussion of oligarchy, focus is given to powerful families. There are encyclopedic references that relate that oligarchy structures are often controlled by a few prominent families, who typically pass their influence/wealth from one generation to the next, even though inheritance alone is not a necessary condition for oligarchies to prevail…

This is the challenge that belies Caribbean society. Most of the property and indigenous wealth of the Caribbean region is concentrated amongst the rich, powerful and yet small elite; an oligarchy. Many times these families received their property, corporate rights and/or monopolies by Royal Charter from the European monarchs of ancient times. These charters thus lingered in legacy from one generation to another … until …

The form of rulership that dominated these times in history is that of Oligarchy; empowered by Royal Charters/Decrees. Today, oligarchy – rule by the rich[4] – is synonymous with another term commonly used, plutocracy.

Zimbabwe Photo 3The subject of oligarchs is very familiar on the African continent. This has been a real issue there. In many countries after colonialism, like Zimbabwe (1980), the cure for the oligarch disease was nationalization – forfeiting and seizing commercial farms and mines. This turned out disastrously for this country; the cure was worse than the disease. But, next door in South Africa (14 years later), the strategy, tactics and implementation was different. This country did not ascend to majority-rule until 1994; the first majority-ruled President there, Nelson Mandela saw the futility of the nationalization strategy amongst the precedent independent African nations, so he pursued an alternate approach to assuage White Flight and keep the capital and skilled labor in the country. But the continuation of the oligarchs ill-gained, and public-perceived-stolen assets forged problems in the reality of economic/wealth inequality. Majority-rule therefore brought no revolutionary change for the average man.

All in all, change is not easy. It is heavy-lifting. This is abundantly clear in the examination of the independent majority-ruled Zimbabwe and majority-ruled South Africa. See Chart in the Appendix of the comparisons.

The details of the Republic of Zimbabwe (1980) evolution are as follows:

The British South Africa Company was a Royal Charter, to administer “North-Western Rhodesia” and “North-Eastern Rhodesia” for White settlement; it was not under those names, but the names of the geographic parts—”Mashonaland”, “Matabeleland”, “Barotseland”, and so on. The collective territories were initially referred to as “Zambesia” – the name origins of both Zambia and Zimbabwe – but became Rhodesia as an international brand. While the White minority community resisted the transition to black majority-rule, the change inevitably came, empowering revolutionary leader Robert Mugabe. The new regime – due to spite, revenge and broken promises – began confiscating White-owned farmlands. This is widely blamed for leading to the deterioration of the Zimbabwean economy (societal abandonment of human and financial capital); this has plagued the country even until this day.[113]

The details of the Republic of South Africa (1994) evolution are as follows:

The Cape Colony was a British colony in present-day South Africa and Namibia, named for the Cape of Good Hope. The British colony was preceded by an earlier Dutch colony of the same name, established in 1652 by the Dutch East India Company – granted by Royal Charter from the Dutch Monarchy. The Dutch lost the colony to Britain following the 1795 Battle of Muizenberg, but had it returned following the 1802 Peace Treaty of Amiens. It was re-occupied by the British following the Battle of Blaauwberg in 1806, and British possession affirmed with the Anglo-Dutch Treaty of 1814. The Cape Colony then remained in the British Empire, becoming self-governing in 1872, and uniting with three other colonies to form the Union of South Africa in 1910. Despite practicing racial segregation for most of its history, eventually integration and black majority-rule evolved in the Republic of South Africa. Despite their resistance to these changes, accommodations and reconciliations on the part of Nelson Mandela allowed for the continuation of the established societal engines; the minority White communities and business interests remained.

Zimbabwe - Photo 4Considering these case studies, the Failed-State status of Zimbabwe versus the economic successes of South Africa, we see a lesson in this history, an obvious appreciation for best-practices … for us to apply in the Caribbean. We can optimize these best-practices by applying regional strategies, tactics and implementations to benefit everyone – the Greater Good – and try not to disenfranchise any one group.

The masses of people in the democratic Caribbean now have the right to rule, not just some special group set aside by Royal Decree or granted power by a Royal Charter. Since there is the scientific fact that no one can go back in time and change history; we can only move forward, hopefully with wisdom from the lessons learned in history. The Go Lean book presents a roadmap on how to benefit from these lessons – good, bad and ugly – and how to empower communities anew; to use political power to impact the Greater Good. We therefore see a role for the Rich (One Percent – Page 224), the Poor (Page 222) and the Middle Classes (Page 223).

The consideration of the Go Lean book, as related to this subject is one of governance, the need for technocratic stewardship of the regional Caribbean society. This point was also pronounced in the opening Declaration of Interdependence (Page 12) with these acknowledgements and statements:

xi.   Whereas all men are entitled to the benefits of good governance in a free society, “new guards” must be enacted to dissuade the emergence of incompetence, corruption, nepotism and cronyism at the peril of the people’s best interest. The Federation must guarantee the executions of a social contract between government and the governed.

xii. Whereas the legacy in recent times in individual states may be that of ineffectual governance with no redress to higher authority, the accedence of this Federation will ensure accountability and escalation of the human and civil rights of the people for good governance, justice assurances, due process and the rule of law. As such, any threats of a “failed state” status for any member state must enact emergency measures on behalf of the Federation to protect the human, civil and property rights of the citizens, residents, allies, trading partners, and visitors of the affected member state and the Federation as a whole.

xiii. Whereas the legacy of dissensions in many member-states (for example: Haiti and Cuba) will require a concerted effort to integrate the exile community’s repatriation, the Federation must arrange for Reconciliation Commissions to satiate a demand for justice.

This Go Lean book serves as a roadmap for the introduction and implementation of the technocratic Caribbean Union Trade Federation (CU) to provide better stewardship for the 30 member-states of the Caribbean region, despite their European heritage. The book (and subsequent blog/commentaries) posits that we must not fashion ourselves as parasites of our previous European colonizers, but rather pursue a status as protégés.

Our past history feature much oppression and repression; European colonialism had been a villainous “dragon”. But we can train our dragons! We can make the most of previous bad history. This point was presented as a strategy for Direct Foreign Investments, asserting that we want to invite and attract investments. We can use their resources to elevate our own communities, while still providing a return/profit for the investors.

This is Pragmatism 101!

We, in the Caribbean, were not the only ones abused. Other indigenous people (Africans, Asians, Amerindians, etc.) also suffered, sometimes even more so. The goal should be to thrive despite the disabling legacy; (and if not for everyone, then make the most of the situation for the most number of people).

This is the community ethos of the Greater Good!

Globalization is now an ‘Agent of Change’ that we must contend with. We must “play nice in the sandbox” with people of other countries, especially those with capital resources. So if a minority group represents a faction that previously exploited our land and forefathers, we cannot expect to extract vengeance against them – Zimbabwe proved the futility of such a quest for justice and inequity. As related in the Go Lean book (Page 151), the best-practice for any governing entity to grow the economy is to protect all property rights; (real, personal or intellectual). This is the “new” New World; and the new formula for success.

Another formula, an economic principle, is that “voluntary trade creates wealth” (Page 21). This fact has often been overlooked in policy decisions for Africa. The following VIDEO portrays this dilemma, decrying the current migrant/refugee crisis in Europe, when the best-practice the continent can provide the African people is a more liberal trade policy, allowing markets for African agricultural produce. (Without this type of proactive strategies, the continent is being oppressed … all over again … by today’s Europe; this is a lesson learned from the Native American Reservations in the US).

Economy – overview Zimbabwe’s economy is growing despite continuing political   uncertainty. Following a decade of contraction from 1998 to 2008, Zimbabwe’s   economy recorded real growth of roughly 10% per year in 2010-11, before   slowing in 2012-13 due poor harvests and low diamond revenues. The government   of Zimbabwe faces a number of difficult economic problems, including   infrastructure and regulatory deficiencies, ongoing indigenization pressure,   policy uncertainty, a large external debt burden, and insufficient formal   employment. Until early 2009, the Reserve Bank of Zimbabwe routinely printed money   to fund the budget deficit, causing hyperinflation. Dollarization in early   2009 – which allowed currencies such as the Botswana   pula, the South Africa   rand, and the US dollar to be used locally – ended hyperinflation and reduced   inflation below 10% per year, but exposed structural weaknesses that continue   to inhibit broad-based growth. South Africa is a middle-income, emerging market with an   abundant supply of natural resources; well-developed financial, legal,   communications, energy, and transport sectors and a stock exchange that is   the 16th largest in the world. Even though the country’s modern   infrastructure supports a relatively efficient distribution of goods to major   urban centers throughout the region, unstable electricity supplies retard   growth. The global financial crisis reduced commodity prices and world   demand. GDP fell nearly 2% in 2009 but has recovered since then, albeit   slowly with 2014 growth projected at about 2%. Unemployment, poverty, and   inequality – among the highest in the world – remain a challenge. Official   unemployment is at nearly 25% of the work force, and runs significantly   higher among black youth. Eskom, the state-run power company, has built two   new power stations and installed new power demand management programs to   improve power grid reliability. Construction delays at two additional plants,   however, mean South Africa   is operating on a razor thin margin; economists judge that growth cannot   exceed 3% until those plants come on line. South Africa’s economic policy   has focused on controlling inflation, however, the country has had   significant budget deficits that restrict its ability to deal with pressing   economic problems. The current government faces growing pressure from special   interest groups to use state-owned enterprises to deliver basic services to   low-income areas and to increase job growth.

‘Time to Go’ – Blacks get longer sentences from ‘Republican’ Judges

“Tell me who your friends are and I will tell you who you are” – Old Adage

This Old Adage was drummed in me as a youth; I may have wanted to question its validity, but time has proven its accuracy. As humans, we are affected by the people we associate with; their values, principles, character, aspirations – or lack thereof – will have an effect on us. This statement even harmonizes with the Bible scripture at 1 Corinthians 15:33, which states:

“Bad companions ruin good character.” – Today’s English Version

This commentary highlights a disturbing trend in American jurisprudence; it turns out that among judges that associates with the conservative political parties or the liberal political parties, one group consistently sentences Black defendants to longer prison sentences. This is indicative of more than just the tolerance of criminality; this shows some hidden bias, that severely endangers the Black populations in America. These judges, despite claims of non-partisanship, are affected by their party.

Say it ain’t so!

The party with the harsher sentences is the Republican Party or GOP (for Grand Old Party).

Sometimes, we need to step back and look at the whole picture before we can notice trends and leanings. This is the common sense in the old expression: “One cannot see the forest for the trees”. This was the purpose of a study on judicial bias; it looked at a range of 500,000 cases to summarize its findings. Intelligence and wisdom can be gleaned from this data.

Title: Black Defendants Get Longer Sentences From Republican-Appointed Judges, Study Finds

WASHINGTON — Judges appointed by Republican presidents gave longer sentences to black defendants and shorter ones to women than judges appointed by Democrats, according to a new study that analyzed data on more than half a million defendants.

“Republican-appointed judges sentence black defendants to three more months than similar nonblacks and female defendants to two fewer months than similar males compared with Democratic-appointed judges,” the study found, adding, “These differences cannot be explained by other judge characteristics and grow substantially larger when judges are granted more discretion.”

The study was conducted by two professors at Harvard Law School, Alma Cohen and Crystal S. Yang. They examined the sentencing practices of about 1,400 federal trial judges over more than 15 years, relying on information from the Federal Judicial Center, the United States Sentencing Commission and the Transactional Records Access Clearinghouse at Syracuse University.

Douglas A. Berman, an authority on sentencing law at Ohio State University, said the study contained “amazing new empirical research.”

“It’s an extraordinarily important contribution to our statistical understanding of sentencing decision making in federal courts over the last two decades,” he said.

It has long been known that there is an overall racial sentencing gap, with judges of all political affiliations meting out longer sentences to black offenders. The new study confirmed this, finding that black defendants are sentenced to 4.8 months more than similar offenders of other races.

It was also well known, and perhaps not terribly surprising, that Republican appointees are tougher on crime over all, imposing sentences an average of 2.4 months longer than Democratic appointees.

But the study’s findings on how judges’ partisan affiliations affected the racial and gender gaps were new and startling.

“The racial gap by political affiliation is three months, approximately 65 percent of the baseline racial sentence gap,” the authors wrote. “We also find that Republican-appointed judges give female defendants two months less in prison than similar male defendants compared to Democratic-appointed judges, 17 percent of the baseline gender sentence gap.”

The two kinds of gaps appear to have slightly different explanations. “We find evidence that gender disparities by political affiliation are largely driven by violent offenses and drug offenses,” the study said. “We also find that racial disparities by political affiliation are largely driven by drug offenses.”

The authors of the study sounded a note of caution. “The precise reasons why these disparities by political affiliation exist remain unknown and we caution that our results cannot speak to whether the sentences imposed by Republican- or Democratic-appointed judges are warranted or ‘right,’” the authors wrote. “Our results, however, do suggest that Republican- and Democratic-appointed judges treat defendants differently on the basis of their race and gender given that we observe robust disparities despite the random assignment of cases to judges within the same court.”

The study is studded with fascinating tidbits. Black judges treat male and female offenders more equally than white judges do. Black judges appointed by Republicans treat black offenders more leniently than do other Republican appointees.

More experienced judges are less apt to treat black and female defendants differently. Judges in states with higher levels of racism, as measured by popular support for laws against interracial marriage, are more likely to treat black defendants more harshly than white ones.

The Trump administration has been quite successful in stocking the federal bench with its appointees, and by some estimates the share of Republican appointees on the federal district courts could rise to 50 percent in 2020, from 34 percent in early 2017.

The study said these trends were likely to widen the sentencing gaps.

“Our estimates suggest that a 10 percentage point increase in the share of Republican-appointed judges in each court would increase the racial sentencing gap by approximately 5 percent and the gender sentencing gap by roughly 2 percent,” the authors wrote. “During an average four-year term, a Republican president has the potential to alter the partisan composition of the district courts by over 15 percentage points, potentially increasing the racial and gender sentencing gap by 7.5 and 3 percent, respectively.”

There are a couple of reasons to question that prediction. The Trump administration has been more energetic in appointing appeals court judges than trial judges. And in recent years many conservatives have started to shift positions on sentencing policy. The very scope of the study, which considered sentences imposed from 1999 to 2015, could mask trends in the later years.

Supreme Court justices like to say that partisan affiliation plays no role in judicial decision making.

“There’s no such thing as a Republican judge or a Democratic judge,” Justice Neil M. Gorsuch, President Trump’s Supreme Court appointee, said at his confirmation hearing last year. “We just have judges in this country.”

Political scientists have disagreed, finding that Republican appointees are markedly more likely to vote in a conservative direction than Democratic ones. Senate Republicans, by refusing to hold hearings for Judge Merrick B. Garland, President Barack Obama’s Supreme Court nominee, seemed to agree.

So has Mr. Trump. “We need more Republicans in 2018 and must ALWAYS hold the Supreme Court!” he tweeted in March.

But judicial ideology is one thing. The race and gender gaps identified by the new study present a different and difficult set of questions.

Professor Berman said the study should prompt both research and reflection. “It only begins a conversation,” he said, “about what sets of factors really influence judges at sentencing in modern times.”

This commentary continues the series on Time to Go, considering the reality for life of the Caribbean’s Black-and-Brown population in the US. Now, this revisit, this commentary, examines a disturbing trend with the sentences of federal court judges; these ones are appointed by the President of the United States. Needless to say, Presidents appoint judges that reflect and respect their values – it’s a natural expectation that they would have the same (virtual) association. So “we” can tell a lot about federal judges, just by knowing which President appointed them.

All of these commentaries relate to Caribbean people and their disposition in foreign lands – in this case in the US – and why they need to Go Back Home. Surely, it is obvious and evident that institutional racism is “Alive & Well” in the US. We can and must do better at home. The Go Lean book – available to download for free – serves as a roadmap for the technocratic Caribbean Union Trade Federation (CU) to assuage the societal defects in this region. It is “out of scope” for our movement to fix America; our efforts to reform and transform is limited to the Caribbean.

‘Republican’ Judges???

This is as opposed to Democratic Judges! Yes, this is a reference to specific political parties in the US. Yet, we are not making these assessments with any political leaning. Rather, this movement behind the Go Lean book and blogs, the SFE Foundation, is an apolitical organization with no favoritism for one political party over the other. In fact, the first 6 commentaries in this Time to Go series were published during the presidential administration of Barack Obama, a Democrat.

It is a dangerous proposition to be Black in America. This is why this movement consistently urges the Black-and-Brown of the Caribbean to Stay Home! In fact, The Bahamas urged its majority Black population (and the young men) to exercise extreme caution when traveling to the US and dealing with police authorities. There is no doubt that the America of Old – would have been no place for Caribbean people to seek refuge. But now we are asserting that the disposition is still the same:

  • Our Black-and-Brown Diaspora should plan to repatriate back to the Caribbean
  • While our young people, in the homeland, should plan to prosper where planted rather than setting their sights on American shores.

Despite the fact that this society – modern America – is still no place for Black-and-Brown Caribbean people to seek refuge, all 30 member-states of the region continue to suffer from an abominable brain drain rate – one report proclaims 70 percent – in which so many Caribbean citizens have emigrated to the US (and other places). We must resist this bad trend! How?!

  • Good messaging
  • Heavy-lifting to reform and transform the societal engines

The Go Lean book identifies the reasons why people abandon their homeland as “push and pull”. While the “push” refers to the societal defects that people take refuge from, the “pull” is mostly due to messaging. Our people perceive that the US is better for them, and that landing in the US is the panacea – cure-all – for all societal short-comings. Good messaging will mitigate that trend. Yet, still, we must do the hard work for fixing our society.

The Go Lean book asserts that it is easier for the Black-and-Brown populations in the Caribbean to prosper where planted in the Caribbean, rather than in the United States. Plus, we need these people’s help to reform and transform our society. We need some to lead, and some just to follow. We need some to produce, and some just to consume. We need growth! So abandonment is counter-productive.

This is the quest of the Go Lean/CU roadmap. The book presents 370 pages of instructions for how to reform and transform our Caribbean member-states. It stresses the key community ethos that needs to be adopted, plus the strategies, tactics, implementations and advocacies necessary to optimize the societal engines in a community. As related in this blog series, it is Time to Go! We have a better chance of optimizing our society in the Caribbean for our Black-and-Brown majority populations than the US will do for our people; we can actually be better than America. Just look, their distinguished judges are still adjudicating like its 1868, and not 2018. America has gone “2 steps forward and 1 step backwards”.

Now is the Time to Go and now is the time to lean-in to this Go Lean/CU roadmap. This quest is conceivable, believable and achievable. Yes, we can … reform and transform our society. We can make our homeland a better place to live, work and play. 🙂

Wait… what?

Yep. Republican. Party of Lincoln. Party of the Emancipation. Party that pushed not only black votes but black politicians during that post-bellum period known as Reconstruction.

Today, it’s almost the exact opposite. That migration of black voters away from the GOP reached its last phase 50 years ago this week.

‘Time to Go’ – Mandatory Guns: “Say it Ain’t So”

There is that Biblical directive:

Live by the Sword; Die by the Sword – Matthew 26:52

While the reference is here to the weapon of a sword, the truism of this statement applies to any weapon.

So for our American counterparts, this version is apropos: “Live by the Gun; Die by the Gun”.

Consider the recent school shootings and mass shootings, is there any doubt to the fulfillment of these words: America and guns go hand in hand.

Title: Georgia City Loses Battle Over Mandatory Gun Ownership Law, Affirms Right Not To Bear Arms

The small city of Nelson, [Georgia], agreed Thursday to revise an ordinance passed earlier this year that required every household to own a gun.

The measure, passed in April, drew nationwide attention for attempting to make gun and ammunition ownership mandatory. The Brady Center to Prevent Gun Violence, a national gun control group, sued Nelson over the law, claiming it was unconstitutional to make those demands of its citizens.

Nelson settled the suit this week when the city council unanimously approved a motion to amend the ordinance, the Atlanta Journal-Constitution reported. Here are the additions to the text:

    WHEREAS, many members of the City Council believe that possessing a firearm in the home is an effective means to defend residents and the community; and
    WHEREAS, the City Council also recognizes that there are other means available to defend families and homes, and the Constitution protects the rights of Americans to choose not to possess a firearm or bring one into the home….

The Brady Center applauded the city council’s decision in a statement:

“The Constitution protects not just the right to bear arms, but the right not to bear arms,” said Jonathan Lowy, Director of the Legal Action Project at the Brady Center. “The Brady Center brought this lawsuit to establish that the Constitution protects the rights of gun owners and non-gun owners alike, and all of us must be respectful of each other’s rights. We are pleased that as a result of our lawsuit the City of Nelson has recognized that the Second Amendment protects the rights of the hundreds of millions of Americans who believe that the best way to keep themselves and their families safe is by keeping guns out of their homes.”

While the idea of mandatory gun ownership is clearly a divisive one, many people on both sides of the issue pointed out that Nelson’s push was never likely to have been enforced. As the Associated Press reported in April, the ordinance had exemptions for convicted felons, those who suffer from certain physical or mental disabilities, and anyone who generally objects to gun ownership.

Lamar Kellett, a Brady Center member and one of Nelson’s 1,317 residents, was concerned that the law could lead to his being punished for opting not to own a firearm, so he sued. On Thursday, he called Nelson’s changes an “acceptable solution.”

Other mandatory gun ownership laws, meanwhile, remain in place largely without controversy. Kennesaw, Ga. has had such a measure on the books since 1982, though the law is rarely enforced, and some residents reportedly opt to ignore it.

Say it Ain’t So! Is this the life that Caribbean people want? It should not be!

Yet, we are losing so many of our people to this eventuality. Our people leave due to “Push and Pull” reasons. “Push” refers to the societal defects in the Caribbean that moves people to want to get way; and “pull” factors refer to the impressions and perceptions that America is better. Surely a mandatory gun culture is not better!

The purpose of this commentary is to relate two strong points of contention:

  • We need to dissuade the high emigration rates of Caribbean citizens to the American homeland.
  • We need to encourage the Caribbean Diaspora to repatriate back to their ancestral homeland.

According to the foregoing article, American life is to “live by the sword/gun and die by the sword/gun”. Despite all the efforts to change this disposition, America’s consistency with guns continue, even now to the point that some communities want to mandate that every household have a gun. This is not the case in the Caribbean.

Yippee! If only, we can “prosper where planted” there.  Yes, we can!

This commentary and the movement behind the book Go Lean … Caribbean asserts that “yes, we can” reform and transform our Caribbean homeland so as to be better places to live, work and play. Where as, Caribbean communities can be elevated and improved, we already comply with common sense gun control, there is no hope for this in America – guns are in their DNA. (Good luck to American Youth demanding change).

For all Caribbean people in America who want a more sound life – gun wise – we entreat you: It is Time to Go.

All of these commentaries relate to the disposition of the Caribbean Diaspora in foreign countries. The Go Lean book and movement serves as a roadmap for the introduction of the technocratic Caribbean Union Trade Federation (CU). The CU is set to optimize Caribbean society through economic, security and governing optimizations. Therefore the Go Lean roadmap has 3 prime directives:

  • Optimization of the economic engines in order to grow the regional economy to $800 Billion & create 2.2 million new jobs.
  • Establishment of a security apparatus to ensure public safety – including regional gun violence abatements – and protect the economic engines.
  • Improve Caribbean governance to support these engines, including a separation-of-powers between the member-states and CU federal agencies.

The “push and pull” factors do imperil Caribbean life. We push our citizens out. Then the resultant effect is a brain drain and even more endangerment to our society: less skilled workers, less entrepreneurs, less law-abiding citizens, less capable public servants – we lose our best and leave the communities with the rest. This create a crisis. The Go Lean roadmap posits that the entire Caribbean is now in crisis; so many of our citizens have fled for refuge in the US and other foreign countries, but the refuge is a mirage. The “grass is not necessarily greener on the other side”. Life in the US, is definitely not optimized – can you imagine living in a community where everyone is mandated to have a gun.

Yes, there is a challenge to reform and transform communities in the US; and there is a challenge to reform and transform communities in the Caribbean. It is easier though, to fix the Caribbean than to fix the American eco-system. So it is Time to Go, so our Caribbean people can do the work to prosper where planted in their Caribbean communities.

Why not simply try to fix America?

The history and DNA of America may be beyond our reach.

Who benefits from a mandatory gun ownership policy?

The Retail Stores and gun manufacturers!

This is Crony-Capitalism at work – exploiting the public good for private profit.

Also underlying the Second Amendment (of the US Constitution) is the white supremacy defect. This ignominious Second Amendment; is a product of the previous Slave Culture, as one original motivation in 1791 was to suppress insurrection, allegedly including slave revolts [60][61][62]. A previous blog-commentary entitled 10 Things We Want from the US and 10 Things We Don’t Want from the US detailed this rationale:

The “right to bear arms” has a personal application beyond the country’s entitlement to maintain a militia. This “right” has been interpreted in a manner in which any normal “man” can get possession of guns and other armament. This proliferation of guns in society results in the highest rate of gun violence in the world, even an unconscionable rate of school shootings.

The Go Lean roadmap purports that this status has also caused discord – a gross abuse and availability of illegal guns – in bordering communities of Mexico, and Caribbean states of the Bahamas, and the DR. This propels our gun-related crime.

The US still has some societal defects – racism and Crony-Capitalism for example – that are so imbrued that they are tied to the country’s DNA. This is why the Go Lean movement posits that it is easier to effect change at home in the Caribbean, than in the foreign country of the US.

In a previous blog-commentary, a thesis was presented that for Caribbean citizens, it is NOT better to live “fast & furious” in the US, but rather it is better to prosper where planted in the Caribbean homeland. Life in the US may experience a shorter mortality due to the riskier reality, like this dangerous gun culture – this is not just theory, a Caribbean Diaspora’s daughter was killed in the Parkland School Shooting in February 2018. And yet, our Caribbean communities are losing people more and more to the US with our atrocious societal abandonment rates.

While we are declaring that it is “Time to Go“, we are also preparing for the return – fixing our economic, security and governing defects. Our goal is to be an American protégé and not a parasite; maybe to even be Better Than America.

If this is going to be, it starts with me – being residential in the Caribbean homeland. Time to Go!

The vision of the CU is a confederation of the 30 member-states of the Caribbean to do the heavy-lifting of championing better economic and security policies. There is the structure of a separation-of-powers between CU agencies and the individual member-states. So the CU will be able to do more independently than the regional status quo, while also helping to elevate the status quo security deliveries in the 30 member-states.

The Go Lean roadmap provides turn-by-turn directions on how to reform the Caribbean security apparatus to better secure Caribbean society as a whole. This roadmap concedes that the Caribbean is in crisis, but that this “crisis would be a terrible thing to waste”. As a planning tool, the roadmap commences with a Declaration of Interdependence, pronouncing the approach of regional integration (Page 12 – 13) as a viable solution to elevate the region’s societal engines:

x. Whereas we are surrounded and allied to nations of larger proportions in land mass, populations, and treasuries, elements in their societies may have ill-intent in their pursuits, at the expense of the safety and security of our citizens. We must therefore appoint “new guards” to ensure our public safety and threats against our society, both domestic and foreign. The Federation must employ the latest advances and best practices … to assuage continuous threats against public safety.

xi. Whereas all men are entitled to the benefits of good governance in a free society, “new guards” must be enacted to dissuade the emergence of incompetence, corruption, nepotism and cronyism at the peril of the people’s best interest. The Federation must guarantee the executions of a social contract between government and the governed.

xvi. Whereas security of our homeland is inextricably linked to prosperity of the homeland, the economic and security interest of the region needs to be aligned under the same governance. Since economic crimes, including piracy and other forms of terrorism, can imperil the functioning of the wheels of commerce for all the citizenry, the accedence of this Federation must equip the security apparatus with the tools and techniques for predictive and proactive interdictions.

xix. Whereas our legacy in recent times is one of societal abandonment, it is imperative that incentives and encouragement be put in place to first dissuade the human flight, and then entice and welcome the return of our Diaspora back to our shores

Change has now come. The driver of this change is globalization. Caribbean people have been emigrating in their search for a better life. Nelson, Georgia – from the foregoing article – should not be that destination. Nor should any community that refuses to implement common sense gun control. The bottom-line should not include sacrificing our children. The bottom-line motive should be the Greater Good – “the greatest good for the greatest number of people which is the measure of right and wrong – not profit, prejudice nor emigration.

In the Caribbean, we need to dissuade our people from leaving … and incentivize many of the Diaspora to return. We need our people to help us reform and transform our societies. Fleeing to America is not the answer! The grass is not greener on the other side. There are far too many guns in America for that society to be inviting. No, America is not the panacea for all of the Caribbean ills. To the contrary, we must reform and transform our own society.

The Go Lean/CU roadmap asserts that now is the time for all of the Caribbean – residents and Diaspora – to lean-in for the empowerments described here in the book Go Lean … Caribbean. This is conceivable, believable and achievable that we can elevate our homeland and to make our communities better places to live, work and play.

In Life or Death: No Love for Puerto Rico

The American association is just not working for failing Puerto Rico (PR). This is no longer a theory; this is now a fact!

The devastating Category 5 Hurricane Maria came by and desolated the island, 9 months ago (September 18, 2017). The restoration and recovery is finally complete …

Wait, no!

The restoration and recovery is still not complete, even though it’s the eve of a new Hurricane Season (June 1).

In life, Puerto Rico just gets no love.

Unfortunately, this is true in death too – we learn now that even the resultant deaths from Hurricane Maria had been under counted.

What? How? Why?

The act of counting deaths is more straight-forward than the Washington and San Juan officials would have you believe. Simply count the number of mortalities (death certificates issued) for the 4th Quarter of the last few years. The PR government try to assert that the number of deaths were 64 people; and yet demographers and other social scientists counted the mortality rate for 4th Quarter 2017 and the 4th Quarters in previous years and the real count is more like:

Wait, wait … don’t tell me! According to this story here, “researchers concluded the final death count could [actually] be as high as 8,500”:

new Harvard University study says the death toll from Hurricane Maria last year is dramatically larger than reported. The study, published in the New England Journal of Medicine, estimates more than 4,600 people died on the island. The official government death toll is just 64.

Researchers randomly knocked on doors and asked if anyone died thereThere were more questions — but that’s how it started. It took six weeks and $50,000 from Harvard to come up with a number that is stunning, reports CBS News’ David Begnaud.

Puerto Rico’s Governor Ricardo Rosselló, who himself is a scientist, seemed blindsided by the Harvard study. His government wasn’t involved and he didn’t know it was being released.

“We welcome all studies,” Rosselló said at a press conference Tuesday. “We want the real number to come out. We had a protocol that really was subpar and we recognize it.”

The government protocol is for doctors to tell the government if a death was caused by Hurricane Maria. Families have to petition the government to investigate if they disagree with a doctor’s opinion.

The Harvard study surveyed more than 3,000 homes across the island and found the mortality rate rose 62 percent in the three months after Hurricane Maria compared to that period the year before. Researchers concluded the final death count could be as high as 8,500.

“One third of our deaths were reported because lack of medical treatment,” said Domingo Marques, who was a lead author of the study.

During his visit to Puerto Rico last October, President Trump hailed the low death toll, which at the time was 16. He compared it to Hurricane Katrina. In light of the Harvard report, a White House spokesperson said the people of Puerto Rico deserve nothing less than transparency and accountability.

“The negligence that allowed those lives to be lost, needs to be accounted for,” San Juan mayor Carmen Yulín Cruz said.

Cruz has blasted Mr. Trump for being tone deaf and slow to respond. When asked to evaluate her own response she said, “I know I didn’t get to everyone… We did the best we could, but that wasn’t’ good enough. That wasn’t good enough.”

Why this story is more than just a shocking number? For every death that is certified by a government official to be related to Hurricane Maria, family members are eligible to have the federal government help pay for funeral expenses. The numbers matter.

Wow; these people, this island – Puerto Rico – don’t even get respect in death.

Call a spade a spade!

There is no love for Puerto Rico. (This is not “our” assessment alone; see the Mayor of San Juan in the Appendix VIDEO).

Time to make a move! It is past time now for Puerto Rico to change from its parasite status as an American Protectorate and graduate to being a US State. Or maybe, it’s time for Puerto Rico to divorce the American relationship entirely and become an independent nation – as was done in the Philippines. In a previous commentary by the movement behind the book Go Lean…Caribbean, the assertion was that the American association maybe the problem for Puerto Rico. That blog-commentary stated:

Where is your pride Puerto Rico? “Have you no sense of decency?” You are not being loved; you are being pitied.

No wait, even the pity is gone – compassion exhaustion after the prior hurricanes Harvey and Irma; plus forest fires in California.

Puerto Rico: You “cannot win; cannot break-even and cannot get out of the game”.

… Puerto Rico is now at the cross roads; things will get worse before it gets worse! … The outcome for Puerto Rico, and other Caribbean islands, would be defection – “forced uprooting-displacement of large communities”. Truly, this is what has happened.

The book Go Lean…Caribbean – available to download for free – serves as a roadmap for the introduction and implementation of the technocratic Caribbean Union Trade Federation (CU), for the elevation of Caribbean society – for all member-states, including the American Territories of Puerto Rico and the US Virgin Islands. This roadmap asserts that regional integration is the key for future Caribbean success; it thus presents these 3 prime directives:

  • Optimization of the economic engines in order to grow the regional economy to $800 Billion and create 2.2 million new jobs. Puerto Ricans have been defecting for decade looking for jobs.
  • Establishment of a security apparatus to ensure public safety and protect the resultant economic engines. This security pact encompasses an emergency planning/response apparatus to deal with the reality of natural disasters. The CU mandate is to protect against any Failed-State
  • Improve Caribbean governance to support these engines, including a separation-of-powers between the member-states and CU federal agencies.

To Puerto Rico, we entreat you: there are successful countries that are separate and detached of America. Your status quo is not the only destiny.

The Go Lean book stresses reform for Caribbean society. It reminds the readers of the American Revolutionary experience: the original 13 colonies were failing under the weight of their British baggage. So to reach success, they had to “break of the shackles“ of British colonialism.

This is Puerto Rico today! They need to “break of the shackles of American colonialism”. This island needs to echo the revolutionary sentiments of “Founding Father” Thomas Jefferson, who wrote in the Declaration of Independence:

… That whenever any form of government becomes destructive to these ends, it is the right of the people to alter or to abolish it, and to institute new government, laying its foundation on such principles and organizing its powers in such form, as to them shall seem most likely to effect their safety and happiness. Prudence, indeed, will dictate that governments long established should not be changed for light and transient causes; and accordingly all experience hath shown that mankind are more disposed to suffer, while evils are sufferable, than to right themselves by abolishing the forms to which they are accustomed. But when a long train of abuses and usurpations, pursuing invariably the same object evinces a design to reduce them under absolute despotism, it is their right, it is their duty, to throw off such government, and to provide new guards for their future security. — Such has been the patient sufferance of these [former] colonies …- book Go Lean…Caribbean (Page 10).

These words, this break from a failing status quo was an early motivation for the CU/Go Lean roadmap, as pronounced in the opening Declaration of Interdependence (Pages 12 – 13) of the book:

xi. Whereas all men are entitled to the benefits of good governance in a free society, “new guards” must be enacted to dissuade the emergence of incompetence, corruption, nepotism and cronyism at the peril of the people’s best interest. The Federation must guarantee the executions of a social contract between government and the governed.

xii. Whereas the legacy in recent times in individual states may be that of ineffectual governance with no redress to higher authority, the accedence of this Federation will ensure accountability and escalation of the human and civil rights of the people for good governance, justice assurances, due process and the rule of law. As such, any threats of a “failed state” status for any member state must enact emergency measures on behalf of the Federation to protect the human, civil and property rights of the citizens, residents, allies, trading partners, and visitors of the affected member state and the Federation as a whole.

xvi. Whereas security of our homeland is inextricably linked to prosperity of the homeland, the economic and security interest of the region needs to be aligned under the same governance. Since economic crimes … can imperil the functioning of the wheels of commerce for all the citizenry, the accedence of this Federation must equip the security apparatus with the tools and techniques for predictive and proactive interdictions.

The CU treaty facilitates a reboot of the region’s economic engines, security apparatus and emergency management(preparation/response for the 30 member-states, 42 million people and $800 Billion GDP. The treaty allows for theestablishment of Self Governing Entities where the CU will be the municipal administrator – this allows for civic planning, zoning, demolitions and imminent domain decision-making separate from the member-states. While too, dispositions of abandoned buildings in the member-states still relate to CU missions, as in the protection of image (“psychological trauma” is inflicted daily on neighbors of abandoned structures) and the quest for beauty. While beauty, aesthetics and preservation may be paramount for communities, these should only be a concern after basic needs are satisfied – housing is a basic need. Abandoned buildings are a security concern for the community as these buildings are often used as drug “dens” or to house other illegal/criminal activities. Playing children can also be ensnared by dilapidated structures and thus consume emergency medical services. Therefore, impacting turn-arounds of abandoned properties is proactive for CU security.

To Washington, these Caribbean islands are far-off territories – out of sight, out of mind. But these Caribbean islands are our home:

So the Caribbean stakeholders in the region must be the ones to foster the workable solutions for the region: a better disaster preparation and response apparatus. We must not count on the “kindness of strangers”!

Duh!!! – The jury is in! They do not even count our dead!

The Way Forward for Puerto Rico must be the Way Forward for the rest of the Caribbean region – we are “all in the same boat”.

Hurricane Season 2018 starts tomorrow – June 1. (The American president, Donald Trump, even denies Climate Change as a fact or a science. By denying our reality; he is denying “us”).

This assertion – Puerto Rico needing to rely more on their geographical neighbors rather than the American hegemony – is not new. This has been the consistent pleading from this Go Lean movement. Consider these previous blog-commentaries:

‘Loose Lips Sink Ships’ – Undermining College Enrollment

Loose lips sink ships …

… this is an American-English idiom meaning “beware of unguarded talk”. The phrase originated on propaganda posters during World War II.[4]  There are similar expressions in other cultures:

The British equivalent used “Careless Talk Costs Lives“, and variations on the phrase “Keep mum“,[5] while in neutral Sweden the State Information Board promoted the wordplay “en svensk tiger” (the Swedish word “tiger” means both “tiger” and “keeping silent”), and Germany used “Schäm Dich, Schwätzer!” (English: “Shame on you, blabbermouth!”).[6]

Yes, inappropriate talk can undermine societal engines … and economic engines.

Universities, even not-for-profit ones, need to preserve their economic engines. They must have an influx of new students to replace the ones that graduate every year. Where do these students come from?

The economics of universities are simple, especially state-sponsored universities:

  • In-state students pay a per-credit fee for tuition, since state taxes subsidize schools
  • Out-of-state students pay a higher per-credit fee, sometimes double the in-state rate
  • Foreign students must pay out-of-state tuition every year; there is no in-state option for them
  • More revenues – and no financial aid or discounts – are associated with foreign students.

For many American universities, the appeal to lure international students is a “hen that lays golden eggs”. It will be unbecoming to compromise this business arrangement. Enter …

Donald J. Trump, 45th President of the United States

As reported in that previous blog-commentary, the “United States is suffering the dire consequence of ‘loose lips sinking ships’ right now. The new President – Donald Trump – has made disparaging remarks about certain foreign groups, and then introduced policies that reinforce his disdain for these foreigners”.

As a result, more and more foreign students are refusing to come to the US to matriculate. See the full article here and the Appendix VIDEO below:

Sub-title: U.S. colleges blame the administration’s immigration policies as they fall behind foreign competitors in vying for international students.

American universities are losing out to colleges in other countries in the race to enroll international students, and they’re blaming President Donald Trump.

Foreign competitors are taking advantage of Trump’s anti-immigration rhetoric, aggressively recruiting the types of foreign students and faculty who would have typically come to the United States for their higher education. The data already show that U.S. colleges are falling behind foreign competitors during the Trump era.

New foreign student enrollment in the U.S. dropped by 3 percent during the 2016-17 school year, and that decline is projected to double this school year, data show. At the same time, universities overseas are seeing increases as high as the double digits. The decline in foreign students enrolling in American colleges is just the latest evidence of Trump’s immigration policies shutting doors in America. The U.S. is also granting fewer visitor visas to people from around the world.

Trump is responsible for the decline in student enrollment, U.S. universities argue — especially his travel ban, which goes before the Supreme Court on Wednesday. Dozens of higher education groups wrote in an amicus brief for that case that Trump’s travel ban is a “clarion message of exclusion to millions” that harms universities’ ability to enroll international students and recruit top faculty.

Overseas, they’re gloating. “We don’t actually need to be negative about the American academy, as President Trump is doing more damage to ‘brand America’ on his own than any competitor country ever could,” Phil Honeywood, the CEO of Australia’s international education association, told POLITICO.

“There is no doubt that President Trump’s much-publicized antagonism toward Muslims and migrants has sent out negative messages to students who would otherwise have America at the top of their list as a study destination,” said Honeywood. Australia — long one of America’s top competitors — has seen big jumps in students enrolling from Muslim majority countries, such as Malaysia and Indonesia and in the Middle East, he said.

And it’s not just Australia, which saw a 12 percent increase in international students last year. Universities in Canada, China, New Zealand, Japan and Spain all posted double-digit increases in international enrollment, according to data from the nonprofit Institute of International Education.

Meanwhile, the U.S. decline tracked by the IIE was the first time that number had dropped in the 12 years the group collected such data. While the 2017-18 data are not yet available, the decline was projected to more than double, based on the findings of a separate online enrollment survey IIE conducted in October.

Universities say they need to continue to attract the world’s brightest students for America to maintain its scientific edge. They argue foreign students often become important economic drivers, pointing to famous foreign-born entrepreneurs like Elon Musk, who grew up in South Africa and graduated from the University of Pennsylvania. International students can also help with the bottom line, since they often pay full freight, and some universities charge them more to attend.

“Where the United States retreats, there’s a vacuum, and other countries will rush to fill it,” University of California President Janet Napolitano, who served as Homeland Security secretary in the Obama administration, told POLITICO. “American education has always led the world — and it still leads the world, and it should lead the world. But we are leading the world in an atmosphere where the White House, at least, is sending a very kind of ‘stay away’ message — and that’s a challenge.”

The university groups wrote in the Supreme Court brief that since Trump signed the travel ban, international students have expressed concerns about coming to the U.S. to study, while faculty have turned down jobs and foreign scholars have pulled out of American academic conferences.

“Foreign students, faculty and researchers come to this country because our institutions are rightly perceived as the destinations of choice compared to all others around the globe,” the brief said. The president’s proclamation “altered those positive perceptions with the stroke of a pen,” it said.

In the case, the Supreme Court will hear arguments that Trump overstepped his authority in issuing an order limiting visas to eight countries, six of which are majority Muslim. Among the questions the justices are expected to consider in the case, which was brought by the state of Hawaii and the leader of a Muslim group there, is whether the president’s order violated the Constitution’s ban on establishment of religion by targeting Muslims.

The administration has contended the travel ban is a necessary national-security step, and government attorneys have argued it’s not related to Trump’s vows on the campaign trail to institute a Muslim ban.

It’s not just the travel ban. The Trump administration is considering restricting visas for Chinese citizens, which could hurt Chinese students studying at American universities. Administration officials portray the possible restrictions, as well as steep tariffs, as a response to alleged intellectual property theft.

American colleges, meanwhile, have aggressively pushed for lawmakers to find a way to preserve the Obama-era Deferred Action for Childhood Arrivals program, which protected from deportation and gave work permits to undocumented individuals brought to the country as children. Trump scrapped the program.

Foreign universities have watched the political climate shift and are pouncing on the opportunity to lure away would-be students and faculty.

“At a time of closing borders and closing minds, students from around the world are choosing Canada,” a group of Canadian universities boasted late last year.

Canada saw an 18 percent jump in international enrollment in 2016. New Zealand saw the biggest boost — a 34 percent increase. International enrollment jumped 25 percent in Spain, 13 percent in Japan and 11 percent in China.

“Ten years ago, China wasn’t even on anyone’s radar screen as a competitor,” said Rachel Banks, director of public policy at NAFSA: Association of International Educators, America’s main international education lobbying group. “They were not active. They were not aggressive at all.”

China has set a goal of enrolling half a million students by the year 2020, and the nation is on a path to exceed that goal early, she said. International students have been a big part of that growth.

Many of these countries long have had aggressive strategies to recruit internationally and have built immigration policies around those efforts.

Australia, for example, allows foreign students to stick around for 18 months after graduation to gain experiential training. Graduates in high-need occupations are able to stay and work for as long as four years. And the country has a path to permanent residency for all foreign graduates.

And they’re not just targeting students.

French President Emmanuel Macron last year announced France would give four-year grants to professors, graduate students and other researchers willing to work on climate change research. Just last month, Canada announced its universities had successfully poached 24 faculty members from colleges in other nations. More than half of them came from American universities, including Harvard, Brown and Duke.

Canadian Prime Minister Justin Trudeau has been spending time in Silicon Valley, trying to convince startups there that Canada might be a more friendly place as the U.S. continues to restrict immigration, including through additional scrutiny of work visas.

“That’s pretty telling,” Banks said.

American universities have tried to counter the narrative. Colleges have written letters expressing their continued support for international education, and some have even offered assistance, such as additional housing, for international students. They’ve lobbied aggressively against restrictive immigration policies and entered court battles. The University of California is among the plaintiffs challenging Trump’s decision to scrap DACA.

“The key for us is to be able to still attract the best and the brightest from all over the world,” University of Southern California President C.L. Max Nikias told POLITICO. “That has been part of the strength of who we are as a country.”

College is a big investment; yet nobody wants to spend their BIG money in a place where they are not welcomed.

This lesson must be learned in the Caribbean. We have the same threats afoot. But unlike the US, who has the leverage and surety of “richest Single Market economy in the world” to absorb any fall, our Caribbean member-states are mostly Third World and failing. This commentary has previous detailed how societal deficiency has resulted in a Brain Drain among the educated classes in the Caribbean homeland – all due to “push and pull” reasons. We persecute certain groups in our society; at times our community leaders are projecting “a climate of hate”.

In general, neutralizing a “hateful attitude” has been an ongoing theme for the movement behind the book Go Lean … Caribbean. The book presents the Caribbean region a roadmap to elevate all societal engines, including economics, homeland security and governance. In fact, the prime directives of the roadmap includes the following 3 statements:

  • Optimization of the economic engines in order to grow the regional economy to $800 Billion & create 2.2 million new jobs.
  • Establishment of a security apparatus to ensure public safety for all and protect the resultant economic engines.
  • Improve Caribbean governance for all people, even minority groups, to support these economic and security engines.

The Go Lean book introduces the Caribbean Union Trade Federation (CU) as an intergovernmental agency for 30 regional member-states, to provide a better – technocratic – stewardship for the regional economy. We need all community stakeholders to “not sink ships” with their unbridled hatred and disdain for people who may look, act and speak differently than them.

Learn from the fallacy of President Trump.

Now is the time for all of the Caribbean – the people and leaders – to lean-in for the empowerments described here-in and in the book Go Lean … Caribbean. This is about jobs and economic opportunities – education included; we need better engines to make our region more prosperous. We can elevate our communities through education!

It is conceivable, believable and achievable to make the Caribbean a better place to live, work, learn and play. 🙂

Flying the Caribbean Skies – ‘Shooting Ourselves in the Foot’ – ENCORE

We do not need to blame anyone else; we do bad all by ourselves.

This seems to be the indictment against the Caribbean for its deficient governing policies in managing air travel in the region. So many of the 30 member-states charge excessive aviation fees and airport taxes that they discourage, dis-invite and dissuade trading partners (and tourists) from consuming our shores and hospitality.

So the “defect is our own”. – The Bible

Shrewd management of taxes can encourage or discourage good or bad behavior. For example, high “sin” taxes on tobacco and alcohol tend to dissuade consumption; and tax cuts tend to incentivize investments. This is a known fact! And yet, many Caribbean member-state governments charge exorbitant fees and taxes for basic air travel – sometimes the fees are higher than the air fare themselves – see below.

This subject is part of the focus on the economic realities of “flying the Caribbean skies”. This commentary continues the 3-part series on Flying the Caribbean Skies. Go Lean Commentary –  Caribbean less competitive due to increasing aviation taxes

The book Go Lean … Caribbean relates the significance of supporting the airline industry so as to facilitate the region’s primary economic driver: Tourism.

Tourism is a leisure activity; many times participants in leisure are in no hurry to get to their destinations, they often drive. This relates to countries on a continental mainland; but for islands, not so much. For 27 of the 30 Caribbean member-states, island life is the reality. (Belize is in Central America; Guyana and Suriname are in South America).

If speed is not the requirement then boating should be an option. But the only boating/transport options for Caribbean tourists are cruise lines.

This following article relates the biggest threat to Caribbean tourism is Caribbean governments. These ones are authorized to assess taxes, but for far too often they have targeted airline tickets to generate needed revenues. This is such a flawed strategy, a betrayal of the public trust. They “cut off their nose to spite their face”, as the article here relates:

CU Blog - Caribbean less competitive due to increasing aviation taxes - Photo 1ST. THOMAS, US Virgin Islands – The International Air Transportation Association (IATA) Tuesday urged regional aviation authorities to adhere to the key principles set out by International Civil Aviation Organization.

IATA’s regional vice president for the Americas, Peter Cerda said it is unfortunate that many governments had chosen to ignore the principles, a global issue that was particularly acute in the Caribbean.

Addressing tourism and industry officials gathered here on the occasion of World Aviation Day, Cerda noted that aviation taxes continue to increase the cost of travelling to the Caribbean. He said this made the region less competitive to other destinations.

“Taking the islands as a whole, each dollar of ticket tax could lead to over 40,000 fewer foreign passengers,” he said, adding that US$20 million of reduced tourist expenditure meant 1,200 fewer jobs across the region.

“Caribbean countries must therefore consider the aviation industry as a key element for tourism development,” he advised.

The IATA official noted that in terms of charges, two airports in the region, Montego Bay and Kingston, both in Jamaica, recently proposed airport tariff increases of over 100 per cent so as to attain a return of capital of around 20 per cent a year in US dollars.

He said that measures such as these do not encourage or support the development of the industry in the region.

“The regulators must act strongly and swiftly against such big increases. Governments have to foster positive business environments through consultation with the industry and transparency in order to ensure win-win situations for all,” he warned.

Cerda said the issue of taxes and charges in the region transcends the formal breaches of global standards and recommended practices and that the simple truth is that this region is a very expensive place for airlines to do business.

In the Caribbean, tourism and the aviation sector facilitate and support some 140,000 jobs and contribute US$3.12 billion, roughly 7.2 per cent of the Caribbean’s gross domestic product (GDP).

The airline industry is celebrating its 100th anniversary year in the black, according to industry figures released here. Globally, airlines are expected to earn a net profit of US$18 billion in 2014.

Cerda noted that while that might sound impressive, on revenues of US$746 billion, this is equivalent to a net profit margin of 2.4 per cent or US$5.42 per passenger carried.

“Looking only at Latin America and the Caribbean, the airlines in this region are expected to earn $1.1 billion.”This is a profit of US$4.21 per passenger and a net margin of three per cent. We are in a tough and very competitive business,” he added.

The aviation official said fuel expense across the Caribbean is estimated at 14 per cent higher than the world average, adding that this represents about a third of an airline’s operating costs.

He noted that in the case of the Dominican Republic, although fuel charges were recently reduced, tax on international jet fuel still remains high at 6.5 per cent.

“Another example is the Bahamas applying a seven per cent import duty on Jet fuel. Jet fuel supply is an issue in the region, the complexity of the fuel supply and the seasonal demand is costly and difficult, making fuel costs in the region a challenge for airlines.”

In addition, Cerda noted that airports are using the fuel concession fees as a source of revenue and they are still waiting to see any of these monies re-invested in improving fuel facilities.

On the issue of safety, he said that this has been in the spotlight in recent months, with July being an especially sad month for all involved with aviation.

However, Cerda said despite the recent tragedies, flying remains by far the safest mode of transportation.

“Every day, approximately 100,000 flights take to the sky and land without incident. Nonetheless, accidents do happen. Every life lost recommits us to improve on our safety performance.

“It is no secret that safety has been an issue in this region. Even though it is still under performing the global average, performance is improving,” he said.

The IATA official said that the aviation industry has come a long way since the very first flight from St. Petersburg to Tampa 100 years ago, turning this large planet into one small world.

He said through it all, one thing has remained constant: when governments support the conditions for a thriving industry the economic benefits are felt by all.

However Cerda cautioned that for the industry to deliver the most benefits to the citizens in the Caribbean and spur additional tourism and trade, “we need to be able to compete on a level playing field and have the infrastructure capacity needed to grow.”

He said he remains confident that if the Caribbean governments continue to strengthen their partnership with the aviation industry, “we will deliver the unique transformative economic growth only our industry can deliver, making the second century of aviation in this region even more beneficial than the first”.

This foregoing article highlights a defective premise, predatory taxing, and so thusly depicts the need for improved regional oversight of economic and governing engines.

Yes, the governments need their revenues, but this should not be pursued at the expense of undermining viable economic engines; this is self-defeating. Likewise there was a recent conflict with British Aviation Authorities and their unilateral tax on Caribbean air transport. The solution there/then is the same as now: regional coordination and a heightened advocacy; see AppendixVIDEO.

Change has now come to the Caribbean. The book Go Lean … Caribbean serves as a roadmap for the introduction and implementation of the Caribbean Union Trade Federation (CU), an alliance of the 30 Caribbean member-states. This Go Lean roadmap has 3 prime directives:

  • Optimization of the economic engines in order to grow the regional economy to $800 Billion and create 2.2 million new jobs..
  • Establishment of a security apparatus to protect the resultant economic engines.
  • Improve Caribbean governance to support these engines.

The roadmap calls for the CU to navigate the changed landscape of the globalized air transport industry. There is the need for regional integration, administration, and promotion for Caribbean air travel among local and foreign carriers. The book posits that transportation and logistics empower the economic engines of a community. There must be air carrier solutions to service the transportation and tourism needs of the Caribbean islands. This point is fully appreciated by Caribbean tourism stakeholders; the book relates that the region’s Hotel and Tourism Association channel the vision of Robert Crandall, former Chairman of American Airlines, who remarked at a Caribbean Hotel and Tourism Investment Conference in May 2010 that the region is uniquely dependent on tourism:

“Everyone involved in travel and tourism knows that our [airline] industry is immensely important to the world economy, generating and supporting – either directly or indirectly – about one in eleven jobs worldwide. Here in the Caribbean, it is even more important. On a number of islands, travel and tourism accounts for more than 50% of all employment, and on some islands for more than 75%. Overall, about 20% of Caribbean employment is travel and tourism dependent – something on the order of 2.5 million jobs.” – Go Lean … Caribbean Page 60.

The Go Lean book asserts that air travel options must be optimized to impact Caribbean society – thus the need for more regional coordination, regulation and promotion of the Caribbean’s aviation industry. New models are detailed in the book in which tourism can be enhanced with “air lifts” to facilitate Caribbean events, and “Air Bridges” to allow for targeting High Net Worth markets. This roadmap also introduces the Union Atlantic Turnpike to offer more transportation solutions (ferries, toll roads, railways, and pipelines) to better facilitate the efficient movement of people and cargo.

This is one way the CU will empower the region’s economic engines. This is an example of the change that the CU technocracy will bring!

The world loves the Caribbean; people want to come visit and enjoy our hospitality. It is better for them, and for us in the region that they come by air transport. But cruises are viable options, though the Caribbean communities get less benefits from cruise lines (Pages 61 & 193). We simply “fatten our frogs for snake”. The more dysfunction we create with air transport – like these excessive  aviation taxes – the more we push visitors to the cruise option; meaning less direct-indirect spending: hotels, taxis, restaurants, casinos, etc.

Now is the time to lean-in to this roadmap for Caribbean change, as depicted in the book Go Lean…Caribbean. We cannot afford to undermine our economic strengths with disabling tax policies. This is a public trust, betrayed. The Caribbean can – and must – do better.  🙂
